Imprisoned Necati Özkan speaks out in his fifth letter: A case finished before it began, constructed with old data and abstract statements

Necati Özkan, who was arrested during the operations against the Istanbul Metropolitan Municipality that began on March 19, 2025, pointed to the trial set to begin on May 11, in which he will be tried as one of four defendants, in his fifth letter written from prison.

In his fifth letter written from prison, Necati Özkan stated that the truth would prevail at the end of the trial and reacted by calling it 'a case finished before it began'.

Here is the fifth letter written by Necati Özkan, a former advisor to Ekrem İmamoğlu, from Kandıra Prison:

On Monday, May 11, one of the most untruthful cases of recent years will begin to be heard at the Istanbul 25th High Criminal Court. This is the so-called 'Military and Political Espionage Case' in which I will be tried as one of the four defendants!

A CASE WHERE LEGAL REASON HAS BEEN LOST!

When the allegations in the 'IMM corruption' case, which were served to the public in 10-12 successive waves, did not hold up, a new story was sought to be served to minds poisoned by a climate of paranoia. Thus, an 'espionage' case emerged in which legal reason and state seriousness were lost.

This case, opened with the abstract and untruthful statements of a businessman who was arrested on charges of 'espionage' following a tip-off from his stepbrother—with whom he was in a dispute over the division of assets—and who gave these statements four months after his arrest with the motivation of getting out of prison, attempts to manufacture crime from the 2019 Istanbul local election campaign.

To put it mildly, there is an indictment that is so empty and baseless that it could not even be the subject of an accusation of violating the Personal Data Protection Law. It not only bends the truth; it also reveals that the judicial bodies, which are the fundamental pillars of the state, can move so far away from impartiality that they do not take into account any statement, document, or data in favor of an innocent citizen.

A TRIVIAL CASE!

When you read the 160-page indictment, you witness the extent of the forced effort to derive an accusation of election manipulation from a few WhatsApp messages sent by an ambitious businessman who came to meet me just 12 days before the repeat Istanbul local elections on June 23, 2019, and whom I had only met once before the elections.

Furthermore, the indictment ignores the written, precise, easily understandable, and predictable articles of the Turkish Penal Code (TCK) and attempts to include even legal research and political analysis under the accusation of espionage by leaning on academic concepts such as the 'Mosaic Theory of Intelligence'.

However, the duty of Public Prosecutors is not to invent crimes without legal basis and file lawsuits, but rather, in order to protect the rights of innocent citizens, to not only collect evidence against the accused but also to reveal evidence in their favor. This futile effort was based on the accusation of stealing the passwords of emails belonging to 17 former IBB employees. 

Tuncay Beşikçi, who wrote a detailed expert opinion on February 5, 2026, revealed the truth in all its nakedness. According to this, the data in question had been placed on the Darkweb in 2008, 2014, 2016, 2017, and January 2019. The two hackers, one Ukrainian and one Polish, who committed this crime had been arrested and sent to prison. (See: Link 1)

The expert report dated March 2, 2026, by Cybersecurity Expert Dr. İsmail Sinan Tatlıgil, who was appointed ex officio by the Istanbul 25th High Criminal Court, expressed the same truth in all its simplicity and once again revealed that the data belonging to the 17 emails, which are the sole basis of the so-called "espionage" case, were old data put up for sale on the aforementioned dates. Thus, it has become clear how hollow the story is behind this case, which occupied Turkey's agenda for weeks and created a stir as if the allegation that information that should remain confidential regarding state security and internal and external political interests was given to foreign powers were true.

You do not need to read pages of expert opinions or expert reports to understand the naked truth about the indictment and the 17 emails that form its basis. It is

sufficient to take a look at the one-page "Section-2 Technical Analysis" table that I have presented for your attention as an attachment to this letter. (See: Attachment Section-2 Technical Analysis)

A CASE FINISHED BEFORE IT BEGAN!

In addition to these, in the IBB case, known as the so-called 'Imamoğlu Criminal Organization' case, the details regarding both the 'İstanbul Senin' and 'İBB Hanem' applications were understood through the information, documents, statements, and testimonies that emerged within the scope of the accusation defined as the '13th Action' with similar content, and the 9 defendants accused of these charges were released on April 30, 2026.

Thus, it has been understood how unjust, unlawful, and untruthful the motivation to get two fleeces from one sheep that does not exist truly is.

THE TRUTH WILL PREVAIL AGAIN!

Whatever the intent, as a former military academy student, a retired commissioned officer, and a professional communicator of 42 years, I take this unserious indictment seriously. With all my faith in the law, I will testify so that the public and the authorities tasked with establishing justice understand the truth beyond any doubt.

In this ongoing case, I hope to contribute to our common future and the survival of our state by ensuring that the law prevails.

My only request from you is to read the two reports linked in this letter, or at least take a look at the table which is a summary of the attached expert report, and share the truth with the authorities around you.

As the late Erdal İnönü often used to say, “The truth has a bad habit of coming out sooner or later.”
