Interim ruling in the Newborn Gang trial
The interim ruling was announced on the third day of the fifth hearing in the trial of the leaders and members of the 'Newborn Gang,' who are accused of causing the deaths of infants through negligence and generating illicit profits by referring them to contracted hospitals in Istanbul. The court ordered the release of 3 defendants under judicial control measures and adjourned the hearing until September 9.

An indictment was recently prepared regarding the second wave of operations against the 'Newborn Gang,' which generated illicit profits by referring infants to contracted hospitals in Istanbul and caused their deaths through negligent behavior. With the indictment prepared against individuals determined to have acted in coordination with Fırat Sarı, the alleged leader of the gang, and subsequently merged with the main case file, the number of defendants rose to 58.
The hearing, held by the Bakırköy 22nd High Criminal Court in the courthouse conference hall, was attended by 58 defendants, 19 of whom are in custody, along with the lawyers of the parties involved.
"WE DEPOSITED 50 THOUSAND LIRAS TO THE SSK"
In his defense during the hearing, the lawyer for the detained defendant Gıyasettin Mert Özdemir stated, "Mert's action can be described as patient referral in exchange for financial gain and money. There is no question of Mert performing medical interventions. It has emerged that Mert's action was patient referral. After Mert left his patient referral duties, Serdar Yüksel continued to refer patients. Remzi Karaca also made referrals. These matters are present in the account records. We do not accept the organization connection and SGK fraud charges regarding this referral. Evaluating this as an organization brings a heavy responsibility. There is a competitive situation between Mert and Fırat Sarı. He has been detained for 15 months. We have deposited 50 thousand liras to the SSK to cover the damages. We trust in justice. The matter that will emerge from the file to come from the Forensic Medicine Institute (ATK) is clear."
The lawyer for the detained defendant Tuğçe Toptemel stated that his client has been in custody for 1 year and that there is no suspicion of evidence tampering, requesting her release.
RELEASE DECISION FOR 3 DEFENDANTS
In the interim ruling announced after a 1-hour break, the court panel ordered the release of Esenler Güney Hospital nurse Hüseyin Günerhan, nurse Mehtap Sayar, and nurse Nigar Kubilay, subject to judicial control measures including a 'travel ban' and 'signing in.' The court panel also ruled to lift the judicial control conditions for some defendants who were not in custody.
CONTINUATION OF DETENTION ORDERED FOR 16 DEFENDANTS
Deciding to send the other detained defendants to the Forensic Medicine Institute for health checks, the court panel ordered the continuation of the detention of 16 defendants, including the alleged gang leader Fırat Sarı, and adjourned the hearing until September 9.
