İSKİ General Manager Şafak Başa files application to the Constitutional Court

İSKİ General Manager Şafak Başa, who was placed under house arrest after being detained in the second-wave operation conducted against the Istanbul Metropolitan Municipality (İBB), has applied to the Constitutional Court with a request to lift this decision. Following the application, Başa's lawyer, Kerem Donat, made a statement.

"THE MEASURE HAS BECOME PRACTICALLY IMPOSSIBLE TO IMPLEMENT FOR MY CLIENT"

According to the report by Cumhuriyet, lawyer Donat reminded that his client has been under house arrest for 208 days, noting that Başa has a serious heart condition and has previously undergone open-heart surgery. "The condition of Başa, who needs to be under regular medical supervision and even underwent surgery while under house arrest, shows that this measure is causing consequences so severe that it cannot be implemented," he said.

"NONE OF OUR OBJECTIONS RECEIVED A RESPONSE"

Stating that all their applications to the public prosecutor's office, the criminal judgeship of peace, and the criminal court of first instance since the detention process have remained unanswered, Donat emphasized that they have not even received any formal notification. Furthermore, he stated, "Moreover, since Başa is a civil administrative officer, a judicial investigation was conducted directly against him without regard for Article 3 of Law No. 1700 and Article 17 of Law No. 3628 regarding investigation procedures."

"RIGHTS UNDER THE CONSTITUTION AND THE ECHR ARE BEING VIOLATED"

Lawyer Donat stated that the house arrest decision violates rights guaranteed under Articles 17, 19, and 36 of the Constitution, as well as Articles 3, 5, and 6 of the European Convention on Human Rights (ECHR). He requested that their application be evaluated urgently, taking into account the risks to Başa's health, and that the house arrest measure be lifted immediately.
