Lawsuit filed against defendants preparing for a bombing, seeking up to 31 years in prison

The indictment has been accepted for Davut D. and Ramazan D., who were arrested in 2023 in Diyarbakır on charges of acting as couriers for the PKK and preparing for a bombing. Prosecutors are seeking between 15 years and 6 months to 31 years in prison for each defendant on charges of "membership in an armed terrorist organization" and "unauthorized possession or transfer of dangerous substances."

A lawsuit has been filed against 2 defendants who were arrested last year in Diyarbakır on charges of acting as "couriers" for the terrorist organization PKK and preparing for a bombing, seeking between 15 years and 6 months to 31 years in prison for each on charges of "membership in an armed terrorist organization" and "unauthorized possession or transfer of dangerous substances."

The indictment prepared by the Diyarbakır Chief Public Prosecutor's Office against the detained defendants Davut D. and Ramazan D. has been accepted by the 5th High Criminal Court.

The indictment states that an investigation was launched after information was received that the defendants "arrived by car in the rural area of Bozçalı Neighborhood in Çınar district on September 4, 2023, buried items in the ground, and had connections to the terrorist organization PKK," and notes that a search was conducted around the field near the residence of defendant Ramazan D. on September 5, 2023.

The indictment states that PETN explosive material, A4 explosive, a rocket launcher warhead, a multimeter (current meter), a timed switch system, an explosive circuit system, a time-delayed explosive, and thermal overalls were seized in a container buried in the ground during the search. The following information was shared regarding the report prepared by the Provincial Police Department's Bomb Disposal Bureau:
"It has been determined that the findings obtained are bomb-making materials and that multiple improvised explosive devices could be prepared by combining them. It has been established that the improvised explosive devices that could be prepared with the examined findings possess lethal and injurious properties for living beings, and incendiary, destructive, and damaging properties for inanimate objects."

A secret witness whose testimony was included in the indictment alleged that defendant Davut D., whose photograph they identified, was in contact with Teyyüp Çam, a terrorist organization member codenamed "Reber" who operated in the rural areas of Mardin in 2020, and provided logistical support to the organization.
The indictment states that Çam, who was neutralized during the Eren-5 Operation carried out in Mardin on March 11, 2023, was the so-called Mardin Bagok area leader sought in the "orange" category, and it was determined that the organizational documents found in the operation area contained information about the aforementioned explosive materials and defendant Davut D.

The indictment notes that RDX and PETN residues were detected during an examination of the clothing of defendant Davut D. and the vehicle of Ramazan D., and that Ramazan D.'s fingerprints were found on the seized ammunition.
The following assessment was made in the conclusion of the indictment:

"The explosive material and equipment used in bomb-making were buried by the suspects in the area where they were seized, in line with the instructions of organization members. In this context, it is understood that the suspects are members of the terrorist organization PKK as they established an organic bond with the organization and operated on its behalf. Considering the lethal and injurious properties for living beings and the incendiary, destructive, and damaging properties for inanimate objects of the materials seized according to the expert report, it has been determined that the actions of the suspects also constitute the crime of unauthorized possession or transfer of dangerous substances."

UP TO 31 YEARS IN PRISON SOUGHT

The indictment seeks between 15 years and 6 months to 31 years in prison for the defendants Davut D. and Ramazan D., who were arrested last year, on charges of "membership in an armed terrorist organization" and "unauthorized possession or transfer of dangerous substances."
The trial of the defendants will begin in the coming days.
