The first hearing of the murder trial for Narin Güran, who was reported missing on August 21 in the Tavşantepe neighborhood of Diyarbakır's Bağlar district and whose lifeless body was found 19 days later, began yesterday (November 7).
The first hearing at the Diyarbakır 8th High Criminal Court lasted exactly 14 hours. On the first day of the trial, the detained defendants Nevzat Bahtiyar, brother Enes Güran, mother Yüksel Güran, and uncle Salim Güran, as well as the father Arif Güran, who participated as a "complainant," and witness Gazal Bahtiyar were heard.
The second day of the trial was marked by one defendant deciding not to testify, the father accusing all the defendants, and a witness confirming that the women in the village had been fighting on the day Narin's body was found.
Yüksel Güran's sister, Yasemin Gül, stated that Maşallah Güran had accused others, uttering curses such as, "May your neck break, may you go blind, may God curse you."
The defendants, who claimed they had given their statements under torture, retracted their testimonies given to law enforcement. The lawyers pointed out that no criminal complaints regarding the torture allegations had been filed by the defendants.
The defendants responded to questions on critical issues regarding the resolution of the murder with, "I don't remember, I don't know."
The third hearing of the murder case, which is being followed closely by Turkey, is continuing today.
The defendants were brought to the Diyarbakır Courthouse under the escort of armored vehicles for the hearing, which began at 10:00 AM.
The hearing is being recorded on camera.
The 3rd day of the Narin hearing has begun.
A witness named Cahit is speaking;
Witness; Nevzat and Arif Güran called me because of a car issue. Nevzat explained, then Arif Güran explained.
I told Nevzat that he needed to make a payment. He said he wouldn't pay.
Judge: Did Nevzat say, ''I'll burn everything down, I won't pay''?
Witness: Salim Güran said, ''I'll pay 10 thousand lira, Arif will pay 10 thousand lira, and Nevzat will pay 50 thousand lira.''
Judge: Did Nevzat accept?
Witness: First he said he had no money, then he accepted.
Judge: Did he say, "I will hold them accountable for this money''?
Witness: I didn't see it, I can't take the sin, I'm telling what I saw.
Judge: I thank you for telling what you saw.
Why did you form a family council and intervene in the incident?
Witness: Both of them are our relatives.
Judge: So did they call you to solve this incident?
Witness: Yes, Arif Güran called.
Judge: Did you attend the meetings of the family council?
Witness: No, I didn't attend.
Other witness Veysel Subatan is explaining;
There was a car problem between Arif and Nevzat. I went to Salim's house in the evening.
Judge: Who called you?
Witness: Arif Güran called.
They called Nevzat, and he came too. The car Nevzat gave turned out to be defective, he had to pay 80 thousand. We said, "You are being unfair to Arif." I said, "If you don't pay the 80 thousand, it will be more in court, settle it among yourselves." Nevzat didn't accept, he didn't agree. He said, "I'm not paying this money." He called people whose last name is Kaya. Nevzat said; "I sold the car, it's gone." We tried to find a middle ground so that there wouldn't be any injustice to Nevzat either.
Salim Güran also said; "Since you have gathered at our house, let's solve this issue."
Then Nevzat had accepted what he needed to pay. I don't know how he did it.
Judge: How did he accept?
Witness: As if he accepted it by force.
Judge: Normal. Did Nevzat threaten you?
Witness: No, when we got up from there, we thought the problem was solved.
Judge: Okay, everyone says they paid anyway, but when did this incident happen?
Witness: It's been about 2 months.
Judge: Was there any tension between the Güran and Bahtiyar families after this incident?
Witness: I didn't witness it.
Witness Rubbettin Kaya is explaining;
Witness: He asked if we could come to our house. I went, Nevzat, Salim, Arif were there. I asked the reason for the car issue, Arif Güran said that Nevzat Bahtiyar had brought him a car. They talked about an 80 thousand lira car issue. There was a bit of a verbal argument there. It was said that Salim would give 10 thousand lira, Arif would give 10 thousand lira. Nevzat said, ''There won't be a lawsuit between us.''
Then he turned to Nevzat Bahtiyar and asked, "Is that right, Nevzat?"
Upon this, the Presiding Judge
warned, "Okay, look at me, don't look at Nevzat."
Witness İbrahim Halil Güran arrived;
Judge: Will you testify?
Witness: I will.
Halim: Do it.
Witness: What do I know, they said bring it, we brought it. My little son and I went to the grocery store, we bought ice pops there.
Judge: How much did you buy it for?
Witness: I don't remember, Sofi the grocer is someone who opens the store at midnight for 1 kuruş. I have never witnessed that store closing in my life.
Judge: How many people were there at Süheyla's?
Witness: Bedirhan... (Not understood.)
Former Diyarbakır Bar Association President Nahit Eren intervened:
Nahit Eren: Can you tell me the time you went with your child?
Witness: It was around 17:35.
The lawyer for the Ministry of Family and Social Services asks;
- There was a fire after Narin went missing, do you know the reason?
Witness: How are they going to hit the electric wires together, it's very illogical.
The prosecutor asked; Did you go to the grocery store?
Witness: Yes.
Prosecutor: Was the grocer there in person?
Witness: Yes, Sofi was there.
Prosecutor: He says he had surgery, what surgery?
Witness: You can look at the reports.
The defense lawyer asks;
- You saw a headscarf on the balcony that could belong to Narin. What did you think as a family?
Witness: We always said, if there was a possibility of this child going up to the hill, we thought someone kidnapped her without entering the house. There was never a rumor in our village history that a child would die.
- So you thought she came with the headscarf?
Witness: Yes.
When the mentally and physically disabled witness Süleyman Kaya arrived
The Presiding Judge greeted him by saying, "Süleyman, how are you?"
Later, he went to him and said, "Be comfortable, don't get excited," and gave him water.
Then the questioning began.
Judge: Süleyman, we just wanted to meet you.
Did you go to the grocery store with Enes?
Süleyman Kaya: We went.
Judge: "What did you buy?
Süleyman Kaya: Energy.
Judge: Energy drink?
Süleyman Kaya: Yes.
Judge: Was the grocer old or young?
Süleyman Kaya: Old.
The questioning began with an interesting dialogue between witness Muhammet Yakut and the Presiding Judge.
Presiding Judge: What is Salim Güran to you?
Muhammet Yakut: I don't know.
Presiding Judge: Never mind then.
Muhammet, why did you come, what's up?
Muhammet Yakut: They said I was going to testify.
Presiding Judge: Enes came around 17:30. What were you doing?
Muhammet Yakut: I was washing a car, Muhammet Kaya was there. He said, "Drop me off by the mosque, my step-grandmother will see me and make me work, I want to go home."
The Diyarbakır Bar Association lawyer asks:
- Who else was there?
- Muhammet Kaya and... (not understood) Kaya.
- Did you chat?
- Yes.
- How long did it last?
- About 15 minutes.
- Did you have any other conversation? Who was with you?
- Muhammet and Süleyman Kaya."
- Didn't you see him again that day?
- No, I didn't.
The defense lawyer said there was a name error
Nahit Eren asks:
- Do you remember what time it was when you went home?
- No.
- How much distance is there between your house and the mosque?
- About 200 meters.
- Can you describe, how much is 200 meters?
The witness showed.
The defense lawyer intervened again, saying, "Leading questions are being asked."
Nahit Eren continued.
- Did you have lunch?
- Yes.
- Do you remember what time you left work?
- I don't remember, but I was home at 12:30.
The defense lawyer intervened for the 3rd time, saying "Cross-examination is being conducted."
Presiding Judge: Continue.
The lawyer for the Ministry of Family and Social Services asks:
- Did Enes have an anger problem that day?
- He was as usual.
- What do you mean "as usual?"
- I mean he was calm.
- The weather was hot, he was wearing short sleeves, was there a mark on his arm, anything?
- No, there wasn't.
Witness Muhammet Kaya arrived;
Presiding Judge: Did you see Enes on the day of the incident?
Muhammet Kaya: Yes. Enes, Muhammet Yakut, and Yağmur left.
Presiding Judge: Was Enes angry?
Muhammet Kaya: No, he was calm.
Muhammet Kaya: Muhammet, Yağmur, and Enes got into the car.
Presiding Judge: Why?
Muhammet Kaya: Muhammet Yakut said, ''I'm going home, drop me off too, Enes.''
Presiding Judge: And then you continued your normal life?
Muhammet Kaya: Yes.
Presiding Judge: "Do you know Süheyla's house?
Muhammet Kaya: I know it.
Presiding Judge: Did you go there?
Muhammet Kaya: I didn't go.
Presiding Judge: Was there a bruise on Enes's face?
Muhammet Kaya: No.
Presiding Judge: Do you remember his clothes?
Muhammet Kaya: No.
Presiding Judge: How would you remember, that's right.
The defense lawyer intervened;
Was Süleyman Kaya with you that day?
Muhammet Kaya: When I went, Enes, Muhammet, and Yağmur were there, in front of the grocery store. Since Enes had just arrived, we hugged each other.
Presiding Judge: Was the grocer there?
Muhammet Kaya: The grocer's son was there.
14-year-old witness M.T.K. was brought to the courtroom, but it was decided not to have him testify because he is a minor.
Electrician Hasan is on the witness stand;
Judge: What were you doing that day?
Witness Hasan: I was an electrician, I met with Salim. We stayed together for 1 hour.
- Had the afternoon prayer call been made?
- I don't know, it might have been.
- Where did you meet?
- In the field.
- Why did you meet?
- There were electrical works.
- Who was there?
- Mehmet Atasoy and Ramazan Atasoy were there.
- What did you do?
- We ate watermelon, we washed our hands with the headmen.
- Did you go anywhere else?
- I left Salim's side around 16:00 approximately.
- You gave a different time in your previous statement.
Witness Hasan could not give an answer here.
Presiding Judge: Do you remember Salim's clothes?
Witness Hasan: No.
- How did you communicate with Salim?
- He was there when we went.
- Did you go impromptu?
- I went directly.
Nahit Eren asks;
- You just said Ramazan Atasoy and Mehmet Selim Atasoy were there.
Hasan: That is correct.
Nahit Eren: You ate watermelon for 15 minutes, then you did the work. You parted ways around 17:30, is that correct?
Hasan: Yes.
Nahit Eren: Were Ramazan and Mehmet Selim Atasoy there around 17:30?
Hasan: No, they weren't.
Witness Abdulsamed Yaşildağ is testifying;
Presiding Judge: How did you talk to Mr. Hasan on the day Narin went missing?
Abdulsamed Yeşildağ: Mehmet Şerif Güran called me, he mentioned a malfunction. I went for repairs, then I said I would do it for this much money.
Presiding Judge: How much did you agree on?
Abdulsamed Yeşildağ: We agreed on 3 thousand TL.
Presiding Judge: You speak very fast, do you do your work this fast too?
Abdulsamed Yeşildağ: Yes.
Presiding Judge: Good for you. Around what time did you talk to Mehmet Şerif Güran?
Abdulsamed Yeşildağ: It was around 16:00.
Presiding Judge: What did you eat in the field?
Abdulsamed Yeşildağ: We ate watermelon.
Presiding Judge: You also ate menemen?
Abdulsamed Yeşildağ: Yes.
Presiding Judge: Who did you eat with? Were there children?
Abdulsamed Yeşildağ: There were 2 children.
Presiding Judge: Girl or boy?
Abdulsamed Yeşildağ: I swear I don't know.
Presiding Judge: Was Ramazan Atasoy there?
Abdulsamed Yeşildağ: Around.
Presiding Judge: Was his father there?
Abdulsamed Yeşildağ: His father wasn't there.
Presiding Judge: What time did you leave there?
Abdulsamed Yeşildağ: Around 17:40.
Presiding Judge: Who else was there where you ate watermelon?
Abdulsamed Yeşildağ: There was a child.
Presiding Judge: What were they doing?
Abdulsamed Yeşildağ: They were playing games.
Presiding Judge: Do you remember Salim's clothes on the day of the incident?
Abdulsamed Yeşildağ: I swear I don't remember.
The Presiding Judge said that the witness testimonies were finished and that the witnesses could follow the hearing if they wished.
The video of Narin's brother's statement, taken with a pedagogue, is being watched in the courtroom.
Yesterday, when the other brother was testifying, the Presiding Judge had said that the statements of both brothers should not be taken because he was crying. The lawyers had objected.
Afterwards, his statement taken with a pedagogue was watched in the courtroom.
From the statement of Narin's 6-year-old brother
E.G.;
- Who was sleeping in the room?
E.G.: My brother and my mother on the sofa, my brother Muhammed was lying on the floor.
- How did your aunt Hediye come, on her first visit?
E.G.: I don't know that. I don't know her first visit.
- Why did she come on her second visit?"
E.G.: My mother had left the laundry to her, that's why.
- Well, was she in a hurry?
Example: She was normal.
Presiding Judge: By the way, father Arif Güran came to the courtroom, welcome.
Arif Güran: Thank you.
Question: Where did Narin go?
E.G.: She went to the mosque. She left at 15:00, she didn't come back.
- What were you doing when Narin went to the mosque?
E.G.: We were eating watermelon.
- What did you do then?
E.G.: We went to my aunt's place.
- What was your mother doing when she was at home?
Example: She was sleeping. My aunt came, gave me the laundry, and left.
- Where was your mother sleeping?
E.G.: She was sleeping in the air-conditioned room.
- Did your aunt come again later?
E.G.: Yes, she came for the second time.
- Well, did your aunt get angry at you when she first came?
Example: She didn't get angry.
- Was she ever angry, unhappy?
Example: She was normal.
- Well, that aunt of yours came, she left the laundry to you, what did she do then?
E.G.: She left it and went.
- Well, did she leave in a rush like that?
E.G.: She left calmly.
- Well, did you think about what's happening that day, why are they talking like this?
E.G.: Only Narin wasn't there.
- Did your brothers say anything to you?
Example: They didn't.
- Well, didn't your father ask you? You were at home too, was Narin at home?
E.G.: My father wasn't at home.
- But he came later, right?
E.G.: He came.
The presiding judge addressed Arif Güran; "Mr. Arif, the videos you insist on were watched by the Diyarbakır Chief Public Prosecutor's Office and were skipped because there was no issue." he said.
Arif Güran asked, "Dara-2?"
The presiding judge said, "If this is not what you are talking about, if there is another camera, we will take that too."
Now the video named Dara-2 will be watched in the courtroom.
The presiding judge said, "We will make an evaluation regarding the camera footage. We will call the Diyarbakır Chief Public Prosecutor's Office and ask which recording it is. Let there be no misunderstanding." and went out with the court committee.
Upon the request of Nahit Eren, the recording of the phone conversation that 15-year-old Ramazan Atasoy, who was taken back to prison after stating yesterday that he did not want to be a witness, had with Salim Güran will also be played.
Meanwhile, the Committee returned to the courtroom.
The defense lawyers are trying to get information about the footage.
The presiding judge stated that the footage is being searched for within the folders.
The Kurdish phone recording between Salim Güran and Ramazan Atasoy, requested by Nahit Eren, is being played. Translation is being done at the same time.
Audio recording;
"Something of yours fell in that corner at the end, something that belongs to you, on the slope at the end. The corner of the slope is stone"
Salim Güran intervened;
I said to Ramazan there, ''Come, your sprinkler has fallen''.
Nahit Eren called Enes Güran and asked him to show how he bit his arm. Enes Güran also reenacted it.
Yüksel Güran, Salim Güran, and Enes Güran are being taken out of the courtroom. Only Nevzat Bahtiyar remained in the courtroom among the detained defendants.
Nahit Eren will make a speech.
According to Narin's Forensic Medicine report;
"In this state, it is evaluated that some parts of the corpse remained on land."
Nahit Eren: If I upset the father yesterday, I apologize again.
Mr. President, I request that you project the recording during Nevzat's point-showing onto the screen. I say this with sadness, the larvae and living creatures on the body went to the Istanbul Forensic Medicine Institute.
I am reading from the report: In this state, it is evaluated that some parts of the corpse remained on land.
Nahit Eren: How can a corpse that is in water carry terrestrial larvae?
The footage of Nevzat Bahtiyar showing the location and exploring under the escort of the gendarmerie is being watched.
Nevzat Bahtiyar is watching his own footage while standing.
After watching the footage;
Presiding Judge: This small area is the place where our daughter Narin was left. Go ahead Mr. Nahit, let's have your question.
Nahit Eren: Did you understand this report?
Nevzat Bahtiyar: I didn't understand.
Nahit Eren: This report says; From Narin's remains, I cannot say corpse, the Forensic Medicine Institute said; she was killed 19 days before she was found. Where do they get this from?
From the insects, from the larvae, there were many of these on Narin's body and they are deriving a date from here.
Now the report says; if these remains were completely underwater, these insects would not live.
That's why I'm asking you one more time Nevzat Bahtiyar, did you bury her somewhere else before?
Nevzat Bahtiyar: Absolutely not.
Presiding Judge: Did the whole sack go underwater, did the stone get wet?
Nevzat Bahtiyar: The stone, not all of it got wet, I don't remember very well either.
Nahit Eren: You know that the DSI water was directed there because of the search activities, right?
Nevzat Bahtiyar: Yes.
Nahit Eren: You just said a part of it remained outside, your road distance is 7 minutes at most. What else did you do there?
Nevzat Bahtiyar: I looked for a rope there.
Nahit Eren: As far as we know, the part that remained outside was the leg..
Nevzat Bahtiyar: I don't remember the leg.
Nahit Eren: Did that part remain in the soil or above the water?
Nevzat Bahtiyar: It remained above the water.
Nahit Eren: Mr. President, I have received the answer I was going to get.
Presiding Judge: Nevzat Bahtiyar, turn around and look. So many people are here, we have been here for days. I am not playing on emotions. I am asking as an individual.
--------------Meanwhile, the Presiding Judge took off his robe.-------------
Presiding Judge: Are the statements you gave in the last session true? Is it slander?
Look, new camera recordings might come out
Nevzat Bahtiyar: I don't know
I don't remember.
Presiding Judge: It's not "I don't remember," is there something you are hiding?
Nevzat Bahtiyar: No.
A 1-hour break was given to the hearing.
The 1-hour break of the hearing on the 3rd day of the Narin case, which is being heard at the Diyarbakır 8th High Criminal Court, is about to end.
The court committee is about to return, the hearing will start again in a little while with the defendants being brought in.
Nevzat Bahtiyar was brought to the courtroom under the escort of 4 gendarmes.
Yüksel Güran, Enes Güran, and Salim Güran were brought in.
Arif Güran sat in the section where the witnesses are, close to Yüksel Güran.
The Presiding Judge and his committee have not arrived yet.
The court committee, defendants, witnesses, lawyers, and spectators have taken their places.
The hearing has begun.
Upon the request of the Diyarbakır Chief Public Prosecutor's Office, the Prosecutor is speaking:
"Everything regarding this women's fight has fallen into place, there is no situation left unresolved in the presence of the court. Additionally, so that there are no question marks left, we brought witness 'Oya'. She had footage of herself at the Forensic Medicine Institute, there had been a fight. Let's listen to her."
The Presiding Judge removed Arif Güran from his seat and said:
"The order of the hearing is fixed, everyone's place is known."
Witness Oya Yorulmaz was brought in.
Order is being established in the courtroom due to space problems, some spectators are changing seats.
Witness Oya Yorulmaz is testifying to the Presiding Judge:
Presiding Judge: "Ms. Oya, why did you come?"
Oya Yorulmaz: "I have no connection. My uncle's family, we went there, we went to the Forensic Medicine Institute. The press was following me. My mother is a diabetic, while she was coming from behind, my brother said to me 'sister, be quiet', while I was doing my head like this, the punch came to me."
Presiding Judge: "Who is your brother?"
Oya Yorulmaz: "Taner..." (not understood)
Presiding Judge: "What did you say there?"
Oya Yorulmaz: "I said go make fake news."
Presiding Judge: "To whom?"
Oya Yorulmaz: "To the press."
Presiding Judge: "Are you serious?"
Oya Yorulmaz: "Yes."
Presiding Judge: "I repeat, did you shout 'go speak lies'?"
Oya Yorulmaz: "Yes, because they were making fake news."
The female prosecutor intervened: "I watched it myself, they are punching you."
Oya Yorulmaz: I said it to the press.
The prosecutor requested the continuation of the detention of the detainees.
The Presiding Judge made statements regarding the Dara-2 camera.
He stated that there is quite a lot of footage and that these will be distinguished and brought.
Arif Güran's lawyer is speaking
(Voices are loud)
"Arif Güran is talking about camera recordings. We know that there is an error in the examination request for the recordings taken today. One should not see this request of a father whose daughter was murdered as too much. One should not act with hearsay information. Arif Güran was taken for a statement on November 5. Arif Güran's pain is being skipped over."
Presiding Judge: Dara-2 footage is ready
Prosecutor: There is between 15.05- 15.11
The Dara-2 footage requested by Arif Güran will be watched in minutes.
The screens in the hall are being prepared.
The footage was cut, this is not the footage Arif Güran wanted.
The footage is being watched.
Prosecutor: "There is an improved version of the footage you wanted. Is there a deficiency in the angle, were you able to look from different angles?"
Nahit Eren: "We will watch this for the first time."
Prosecutor: "Let's go to footage 2."
Presiding Judge: "This is the clearest footage by the prosecution. This is what was sent to us."
Defense lawyer: "Are there vehicle movements?"
Presiding Judge: "It just came to us too. Arif Güran, are you sure, is this the footage you wanted?"
Arif Güran: (hawk-eye... Not understood)
Presiding Judge: "The camera you call hawk-eye does not record, it is watched instantly for intervention."
Arif Güran: "If there was any attack on the military zone, isn't it recorded there?"
Presiding Judge: We will request it in writing
There was footage that was opened, it was cut without being played completely. In summary, this is not the footage he wanted.
The footage was cut, this is not the footage Arif Güran wanted.
The footage is being watched.
A lawyer from the Diyarbakır Bar Association is speaking:
"We join the request for the continuation of detention. Birsen Güran gave 4 separate statements and did not accept her previous statements. Was the statement you gave on October 23 in accordance with your true will? In Birsen Güran's statement, there is a very clear explanation that 'Narin came to our house at 17:40'. We think it was directed by Salim Güran. The logic is this: If I found a slipper and thought it belonged to Narin, I would hand it over to law enforcement. Muhammet Kaya takes it into his vehicle, but how can Muhammet Kaya not give it even though he thinks this slipper belongs to Narin?"
Diyarbakır Bar Association lawyer is speaking:
"Why is the family hiding the meetings? Some say it was done, some say it wasn't. The Güran family deleting their phone records is another issue. I ask those here, when was the last time you deleted your phone records? If only Salim Güran had deleted it, we could have thought it might be a coincidence. However, if more than one person is doing this, this situation raises suspicion."
Diyarbakır Bar Association lawyer is speaking to the Presiding Judge:
"Salim Güran makes many calls on the day of the incident. In one call he says 15:16, in his next call he says 'Gypsies might have kidnapped her'. Mr. President, where does Salim know this time from? It is suspicious that Salim Güran tells the other party 15:16 by his own statement. Well, was any step taken towards the gypsies? I haven't come across such a thing.
Mr. President, Salim Güran insists in court 'I didn't change clothes' but he said before that he changed clothes. Which one are we going to believe? Well, what about the vehicle where Narin's DNA was found? The defense lawyers will make their defense in a little while, but Mr. President, that is the only DNA found in the vehicle. Therefore, the DNA did not get there due to the engagement issue months ago."
Diyarbakır Bar Association lawyer is speaking to the Presiding Judge:
"We believe that Yüksel Güran is the perpetrator in this act, there are interviews she gave before. The mother's behaviors towards protecting Enes are strange. Ultimately, the gendarmerie officer has no government with her, but if she says 'what can I do' regarding Enes, this has been correctly identified.
In Enes's statement, there are these contradictions: 'I didn't see Hediye when I went home at 17:30, but I saw Enes when Hediye was leaving' he says. What are these contradictions?"
Diyarbakır Bar Association lawyer is speaking:
"It is claimed that the bite mark on the arm was made by Enes himself. Mr. President, I researched the desert, I read many articles. The body can withstand pain up to a certain degree, cover your mouth and nose; you cannot suffocate yourself after a while. This is something like that too. After a certain level of pain, the body does not allow the action. Even though 3 days passed, Enes's bite mark left very clear marks. Enes cannot bring this about because he is angry."
Presiding Judge: "Thank you, lawyer."
Another lawyer on behalf of the Diyarbakır Bar Association started speaking. He is speaking towards the presiding judge:
"Those who testify in the file act to protect their relatives. Yes, in a village place, no one looks at the clock, but there are situations that cannot be confused; such as how many times a person met with someone, who was with them when they were seen. I want to draw attention to Melike, Maşallah Güran. They might have confused the time, but before, they stated that Narin came 2 times. This means different things. Melike Güran says, 'I woke up at 14:00, Narin came at 17:40'. This is not a matter that can be confused. Now with new statements they say 'Mina came'. Why are these important? All of these show that they gave a joint statement in the form of a scenario."
CONTRADICTIONS REGARDING MELEK GÜRAN AND HER CHILDREN...
The lawyer affiliated with the Diyarbakır Bar Association is speaking:
The fight between the women was talked about a lot; we are talking about the fight between Mişar Yasemin and her daughters. Yasemin is Yüksel's sister, so her reaction when she learned of Narin's death is more sincere than the others. She said quite clearly "if you had told the truth, this situation wouldn't have come to this". Now it is being distorted, it is said that someone was cursed, it is being changed. Even when Enes says 'I took my aunt and moved her away from there', the aunt says 'I didn't see Enes'. There is a kind of contradiction regarding Melek Güran and her children too.
Another lawyer from the Diyarbakır Bar Association is speaking to the Presiding Judge:
"Nevzat Bahtiyar calls Vecdi Bahtiyar, and he calls Salim Güran. Even though Vecdi Bahtiyar is worried about the missing Narin, it is understood very clearly that he is also aware of it.
Vecdi Bahtiyar comes to Diyarbakır after August 24 and September 8 is a date that hurts all of us, the date Narin's lifeless body was found. That day, Vecdi calls Nevzat at 06:34, it is clearly seen here that they are cooperating. Ramazan Atasoy is acting as a lookout. I will also explain to you what Ramazan Atasoy should be begging for."
A lawyer from the Diyarbakır Bar Association is speaking towards the Presiding Judge:
"I am reading Ramazan Atasoy's own statement: 'Because of you, we got into trouble (he says to Salim) commander, Salim was as if he had entered the water up to his ankles.' It is clearly understood here that Ramazan is also aware of this organization."
STATEMENTS DO NOT MATCH
Former Diyarbakır Bar Association President Nahit Eren is speaking:
"There are 4 defendants for murder right now. I am of the opinion that there may be additions in the sense that new perpetrators will emerge in the field of participation in murder. The issue I am most surprised about in the file is this; maybe you are losing the most valuable thing in your life and when you look back, you remember that day stitch by stitch. We say 'What did I do that day?'"
“Unfortunately, we could not experience the perpetrators of Narin being brought with an earlier indictment. I wish the suspicions in the village and the surrounding area could have been noticed earlier. It was delayed in some way. But as I said, the statements of Narin's circle, which they will never forget in their lives and which they should tell second by second, do not match from one day to the next."
FOOTAGE WILL BE BROUGHT
The Presiding Judge made statements regarding the Dara-2 camera. He stated that there is quite a lot of footage and that these will be distinguished and brought.
"PEERS SEE NARIN WAVING FROM THE HILL"
Former Diyarbakır Bar Association President Nahit Eren says the following to the court:
“We were inside this file with this darkness, but every piece of evidence that emerged unfortunately led to a new strategy for the family members. Law enforcement knows the time Narin went missing as 18:00 during the investigation phase. That's why there is 18:00 footage on the camera. Why do you say? Because after she was found, the footage was re-examined, the red vehicle was identified, and Nevzat Bahtiyar was identified as the owner of the red vehicle in some way. As a lawyer who has been working for Narin for months, we determined the time the vehicle was seen after Narin left the house as 15:40. Narin does not give definitive information.
We know the time Narin was killed as after 18:00. Why? Because there is a fiction order. That is, in some way, if it weren't for that accidental camera of the school while she was going home at 15:11, we really wouldn't know where Narin went from where. She is going up the dirt path, her peers who are with her say that Narin is waving at them from the hill. When was this told to us?"
"People who knew this made an incredible fiction towards 17:40. Let Arif Güran also know, we showed an incredible struggle to be privy to everything that entered this file. I did not give a single piece of information in this file to a single journalist. While these suspects were outside, the statements inside were published."
"ACCORDING TO ALLEGATIONS, HOW IS THIS CAR NOT SEEN AT SALIM'S HOUSE"
The complainant's lawyer, stating that he is speaking on behalf of Narin, continues:
"Yüksel Güran really, her son came from a long road the day before, she got up and went to pick okra in the morning, prepared their breakfast, the father is taking them to Batman. Think about it, he is taking an invitation to Batman for his nephew's wedding, what a valuable thing, but the headman is in the village, what is he doing? He takes his children shopping, they come back. Well... Let me continue.
Narin... I am speaking as the complainant's lawyer, I am speaking on behalf of Narin. You say Enes Güran is at home, okay, but you say he is sleeping, proof? There is a need for someone who saw them sleeping at home. Who? Hediye Güran. If Salim Güran, his wife, and children's statements in court are true, there is no chance they didn't see that vehicle. If Salim is in his own house when Hediye Güran goes home, what is happening? But the point we have reached is this; Hediye Güran goes, if you left your laundry and left at 15:00, according to the allegations, Salim is at home at 15:00 and 16:00. How is this car not seen?"
Nahit Eren continues:
"The organization continues like this: 'We need to get Enes out of the house' is thought. But Enes is actually inside the house. We have narrowed base station data that has scientific meaning, maybe we will discuss this.
The prosecutor lady asked. You mentioned the base that Dicle University gave to Salim to Osman Güran. We had an incredible advantage in this file, there is base station data covering the area from the wall, from the vineyards, to Çarıklı. It takes. So I understood this: Mobility is indicated to you according to the changing base. With this file, I understood this: This mobile phone is my footprint. I asked many experts, yes HTS records may not be definitive, but base station data can be accepted as a healthy scientific, cut evidence."
Diyarbakır Bar Association President Nahit Eren is speaking:
"Enes, your only sister has gone missing. Her phone turns off next to the school at 16:13, well, the phone was charging, so how did the charge run out? And when does this phone turn on? At 04:00 in the morning.
Enes was taken out of that house, brought and put in the grocery store. (He means according to the plan) One of the witnesses spoke there. If Enes went out, he got between Muhammet Yağmur. I said describe the 200 meters, he couldn't. It's a very close point. Statements were given that Enes was sleeping at home. Well, there is also negligence in the organization. What does Furkan tell us? Ufuk's brother, I came home and saw my brother alone, he said. I went out and looked, Ufuk wasn't there, he was sitting at home with Enes."
Former Diyarbakır Bar Association President Nahit Eren is speaking about the prison footage:
"In those images, Enes asks for reports and documents every time. I said it in the interrogation, there are details such as the toothbrush and kissing him while going to the mosque. He had an anxious state in some way. We have suspicions about who and how Narin was killed. We absolutely believe that the defendants will receive a conviction. I believe that all four of them are responsible for this murder. For this reason, I think that the detention status of the defendants should continue."
A lawyer affiliated with the Diyarbakır Bar Association is speaking:
"We reiterate that Ramazan Atasoy should be heard as a witness here due to his previous statements. We also request that Süheyla Özkan be heard"
(Süheyla Özkan, Narin's step-grandmother)
A lawyer affiliated with the Ministry of Family and Social Services is speaking:
"The emergence of the material truth in the murder of our daughter Narin is important for everyone. We are complainants against all defendants.
Imam Recep Kaya, Devran Güran (could not pass the stage with the slipper issue), İsa Kaya, İbrahim Kaya (intermediaries who conveyed the offer to Nevzat), and two minor girls also need to have their statements taken.
It is seen that this incident took place within the family and was hidden. Indeed, it has been determined that there is no problem in the debt-credit issue. We request the continuation of the detention status and the punishment of the defendants from the upper limit."
A lawyer affiliated with the Ministry of Family and Social Services is speaking:
"Bite marks and bruises on the eyes are seen on Enes Güran, but unfortunately, no distinction can be made in the bite mark. Salim Güran's vehicle is being examined, DNA is detected in the driver's seat part of the vehicle. When these are detected, uncle Salim Güran is arrested. 6 days later, our daughter Narin's body is found. Yüksel Güran is quite sure that her daughter is dead, and she is in an effort to protect her son Enes. These are not my statements, these are data based on gendarmerie records.'
'The key name is Enes Güran. He has meetings with his siblings. He says to Eren Güran, 'Brother, don't talk to anyone'. Although it is against the law for these meetings to be published, I accept this as evidence. He says the bruises on the suspect's eyes were first in the cornfield. However, how many days have passed? Therefore, we think the key point is Enes Güran.'"
Salim Güran spoke: "Most of it is a scenario, they say they killed this child at home, they shifted the base, how can such a thing be? She is an angel at 8 years old. I am innocent, I want my acquittal."
"EVEN THE MINISTER OF THIS COUNTRY DID NOT OFFER CONDOLENCES"
Salim Güran's lawyer Onur Akdağ is speaking.
“Even the minister of this country has not offered condolences to this family with these tabloid news. An indictment that satisfies us lawyers has not been prepared. The integrity of the investigation has been broken, while there are dozens of detainees regarding the same incident, excuse me but they say haste makes waste. This haste will lead us to error. The investigation has been focused on the Güran family intentionally from the very beginning. Did the family take them to fortune tellers?
I ask you; doesn't the house have a door? Doesn't the door have a lock? If the allegations are true, would those 3 children have let the uncle live in that house? The other allegation is that Enes killed the child. When we look at the HTS records, you cannot see any contact between Salim Güran and either Enes or Yüksel
That child did not go up to that hill, she was brutally murdered by Nevzat. Mr. President, there is also a concept called killing for no reason. It is nonsense for 4 people to kill for no reason. The truth is that a tiny body was buried in the ground
The family went to Batman and Derik to distribute Uğurcan Güran's wedding invitation. Nevzat knew this, he planned it in advance. His mother Zeynep Bahtiyar had asked in advance who would go where. Mr. President, the filth and cruelty Nevzat did is obvious. We are one hundred percent sure that this was done by Nevzat. Nevzat is a murderer.
The child being wrapped in a blanket is a fake story. There is no blanket in the middle. Nevzat stated that he was afraid of Salim. If he is afraid, why is he changing his statement? He has already tied his own sin to Salim's neck.
Nevzat is also never afraid of the family. Did a tiny body read something she shouldn't have seen? An 8-year-old innocent is killed because she is a tomb, but a 50-year-old is involved in the crime. Does it fit into reason and logic?
Nevzat Bahtiyar tried to strangle the former headman with his hands. If Salim Güran hadn't saved him, he would have given his soul too. Do you see the similarity in the act? Look at the statements of Bahtiyar's children. Ferhat Bahtiyar said, “My father did not react to Yüksel's wailing.” Nevzat's own daughter stated in her statement how sad Salim was.
According to the base report that the prosecutors clung to with 4 hands, it consists of a fantasy that shows the base room by room. We request that the technical experts regarding the narrowed base be heard ready in the hearing. It is said that Salim went to Eğerturmaz Creek at night. Was it determined with a narrowed base, is that so? A total lie. Who has the nerve to leave somewhere in front of law enforcement that night? A camera footage was brought out. Where that vehicle is really going from where, it must be determined. One of the biggest pieces of evidence in the file is the DNA in Salim's vehicle. Fatal importance is attributed to DNA residues, wasn't it taken into account that Yüksel said her daughter had previously gotten into that vehicle and gone to the engagement?
In the investigation conducted by the Diyarbakır Chief Public Prosecutor's Office, all laws were violated and statements were taken with prohibited methods, tortures were applied, my client was subjected to heavy insults by the gendarmerie and was left standing with reverse handcuffs for a long time under pressure. A high-ranking commander spoke in the form of 'We will take you to Iraq, we will change your face'."
NEVZAT BAHTİYAR: I AM ALSO GUILTY BUT...
Presiding Judge: What will you say?
Nevzat Bahtiyar: I am also guilty, I am not objecting but these things thrown on me are lies.
Nevzat Bahtiyar's mandatory lawyer spoke: "As a woman, we decided not to withdraw from the file for Narin."
Presiding Judge: "We thank you for this."
Lawyer: "Our goal is for the material reality to emerge. Nevzat is recording all his statements as far as he remembers. Therefore, there is no issue we will add. Nevzat said that he did not kill our daughter, if we know the murderer, there is no purpose for us to be here. Although it is perceived as if Nevzat Bahtiyar is the person who killed, I am sure 85 million want the real perpetrator to be found. We have no issues to add to Nevzat's confessions. I leave the detention request to our court."
A 5-minute break was given to the hearing.
YÜKSEL GÜRAN: KILL ME BUT DON'T SPEAK ABOUT MY HONOR
Presiding Judge: You listened to the witnesses and lawyers, what do you say?
Yüksel Güran: Right now, I am the most painful mother in the world, the most painful, the most victimized. I both gave my daughter to brutality, and they accused me of my honor, and I couldn't go to her grave. I suffered so much, no one said. They accused me with a shawl. If I were my daughter's murderer, I wouldn't have shown it anyway. If I were the murderer, I didn't say. Law enforcement accused me of killing my son. I may be ignorant but I am a smart woman. No one said, they threatened to kill your son. No one thought I said Enes, Enes. I will never forget the voices, the tortures of my brothers-in-law, my elites. I said mother, I am a mother, a mother who lost her daughter. The police spat in my face and didn't even let me wipe my face. I am speaking instead of the murderer, if his wife had seen this cruelty, Nevzat would have spoken. Hang me, kill me, but don't speak about my honor. No one is telling the truth, they are deceiving us with lies. We didn't deserve this. Bring out whatever there is. I am calling out to Turkey, if we are the murderer, hang us.
I haven't gone to school. I forgot my daughter, I am worried about my honor. Salim is my brother. If a woman's eyes were elsewhere, I wouldn't have been slapped one day. Let Narin's murderer come out. Who are we? Whose child have we killed? It's a shame on you. I am a mother, what's up with you. How will you put your hand on your conscience?
Enough! Why are you doing this to us? What are they accusing us of? Enes was crazy that day, crazy. The gendarmerie is by my side, if I were my daughter's murderer, why would I show her headscarf? Everything is obvious. There is no one but God. You ruined us.
It turned out that the report regarding Enes Güran using drugs is available in the file and the result is negative.
Yüksel Güran's lawyer: "Turkey owes an apology to Yüksel Güran. As a Kurdish woman who has been deprived of the right to education due to gender inequality, a mother who cannot explain herself has not even been able to see her daughter's grave. I request the release of a mother who has not yet seen her daughter's grave."
Enes Güran: "They say, there is a contradiction in his statements, did anyone stand up and say what kind of torture we were subjected to? The men who tortured me are watching me here right now. No one stands up. One of you stand up and say, these people were subjected to torture. They were watching my mother's video and laughing. They hit with a police baton, treated me like a donkey, broke my tooth, they came, statement this and that... I came to the time of committing suicide in prison. I saw my sister in my dream one night in a wedding dress. My father said to me, “Be strong for Narin". I ate so many insults there.
Until now we were saying the state. We said it is behind us. Why did they do this when the corpse was found? The prosecutor said to me, even if you are innocent, you will be punished for life. They said to me, is there a relationship between you and your mother? She is my mother, she is my mother! What is this for God's sake? They slandered me, insulted me. I was tortured. The only person I called was my brother. Let my father not be sad."
Arif Güran was taken out of the courtroom crying, he said, “I leave you all to God”.
Enes Güran: "When I was looking for my sister, the gendarmerie I called brother said to me "Is there a relationship between you and your mother?" Narin, when I came from Malatya, she said to me "Brother, you were going to buy me a doll". I said to her "I will buy you a wedding dress". I bit myself, then they, "Will the sister-in-law think tomorrow or the next day, did Narin bite?" so I was showing that I bit my own arm. Then they started beating me.
They put drugs in my soup in prison. When I woke up in the morning, I woke up with foam in my mouth. They say you said 16.30 in my second statement, oh, they brought me a fake lawyer there. They said to me, "If you did it, confess, you are young, you won't go to prison," they said. I was at the mosque, a messenger said to me, "Your sister's corpse has been found," he said. I didn't believe it.
A commander came, we made a report, "You have a relationship with your mother," he said. I said you are lying, they beat me by leaning me against the wall with reverse handcuffs. I said "Why are you hitting?", they said "I feel like it". On the last night, they watched the video of them beating my mother again and laughed. Why did I stay silent? So that this man wouldn't be sad. (Pointing to his father)
They accused me with Narin. Whether it's Nevzat or Salim, whoever it is, they cannot come and take my sister from my hands. I had one sister. Even if my life goes, I cannot stay silent. Leave me in prison for years but don't accuse me with Narin. Those who tortured me are here. Look, they are there. These men are looking at me here laughing. I am crying here for my Narin."
NEGOTIATION FOR INTERIM RULING
A break was given to the hearing. First, the defendants were taken out. The court committee withdrew to negotiate to give an interim ruling.
After the break, the court committee announced its interim ruling in the Narin murder case. The court ordered the continued detention of the 4 defendants.
In the Narin murder case, the court decided to examine the narrowed base records in detail.
The Narin murder case was postponed to December 26.
