The investigation initiated by the Adıyaman Chief Public Prosecutor's Office Earthquake Investigation Bureau into the death of 37 people following the collapse of the Zümrüt Apartment in the Yeni Sanayi neighborhood during the February 6, 2023, Kahramanmaraş-centered earthquakes has been completed.
CONTRACTOR, MUNICIPALITY, AND PERSON WHO ADDED A FLOOR FOUND AT FAULT
The indictment prepared against the arrested contractor defendants B.K. and his sons Y.K. and E.K., as well as the fugitive defendant, static technical supervisor S.G.H., which seeks up to 22 years and 6 months in prison for each for the charge of "causing the death of more than one person through conscious negligence," has been accepted by the Adıyaman 2nd High Criminal Court.
In the indictment, it was stated that according to the statements of the complainants, the Zümrüt Apartment, which is the subject of the investigation, collapsed in a short time during the first earthquake that occurred at 04:17.
The indictment noted that an examination was conducted by an expert committee appointed by the Chief Public Prosecutor's Office to determine the condition of the building where deaths and injuries occurred following the earthquake, and that core and rebar samples were taken from the building's columns and beams and preserved. It was also recorded that the reports prepared by the expert committee were submitted to the Karadeniz Technical University (KTÜ) committee.
In the indictment, it was stated that the analyses conducted by the KTÜ committee revealed that the core values of the structure were low, and because the yield strength values of the materials used for the reinforcement were not at an acceptable level, the contractor responsible for the structure, the technical application supervisor, and the municipal building control unit were primarily at fault, and the person who added the terrace floor was also found to be at fault.
