A male nurse who was put on trial for allegedly sexually assaulting a female cancer patient receiving treatment in the intensive care unit at Ege University (EÜ) Faculty of Medicine Hospital has been sentenced to 25 years, 7 months, and 15 days in prison.

The hearing at the İzmir 20th High Criminal Court was attended by the detained defendant E.K., the lawyers for the parties, and the complainants.
Given the floor during the hearing, E.K. stated that he was sorry for the incident and requested his acquittal.
The public prosecutor, in his opinion, requested a total prison sentence of up to 40 years and 6 months for the defendant, as stated in the indictment.
The court panel sentenced E.K. to a total of 25 years, 7 months, and 15 days in prison, including 16 years and 3 months for the crime of sexual assault and 9 years, 4 months, and 15 days for supplying narcotic substances, with discretionary mitigation applied.
One member judge dissented regarding the application of discretionary mitigation to the defendant, stating that it should not have been applied.
THE INCIDENT
Male nurse E.K. was arrested on May 25, 2023, for allegedly sexually assaulting a female cancer patient receiving treatment in the intensive care unit at Ege University Faculty of Medicine Hospital.
In the indictment prepared by the İzmir Chief Public Prosecutor's Office, it was stated that following the allegation that nurse E.K. sexually assaulted the victim during the night hours of May 17, witness statements were taken and camera footage was examined, and that the recordings showed the suspect approaching the unconscious patient, administering drugs, and carrying out the act of sexual assault.
In the indictment, a prison sentence of up to 40 years and 6 months was requested for the male nurse for the crimes of "sexual assault against a person who cannot defend themselves physically or mentally by abusing public duty" and "supplying narcotic and stimulant substances."
While the trial of the male nurse continued at the İzmir 20th High Criminal Court, the İzmir 5th Administrative Court ruled that 600 thousand liras in non-pecuniary damages should be paid to the family in the compensation lawsuit filed by the family against the rectorate, and the parties appealed the decision.
The 6th Administrative Litigation Chamber of the İzmir Regional Administrative Court found the decision given by the court in the compensation lawsuit filed by the family against the rectorate to be in accordance with the law.
