Petition from Eylem Tok's lawyer to the court that issued the extradition decision: 'Her life is in danger in Turkey'

Jennifer M. Herrmann, the lawyer for Eylem Tok, who fled to the US with her son Timur Cihantimur after he caused the death of Oğuz Murat Aci in a car accident while driving without a license in Istanbul, has requested that the extradition process to Turkey be halted.

Herrmann submitted a petition to the court requesting a 60-day stay of proceedings in order to prepare an appeal against Tok's extradition.

The petition argues that a temporary suspension of the extradition is a legal necessity, emphasizing that Tok needs additional time to fully exercise her legal rights.

"HER LIFE IS IN DANGER IN TURKEY"

The petition argues that Tok would face serious risks if extradited to Turkey. Specifically, it is claimed that Tok and her family have received death threats in Turkey, and it is alleged that there is a high probability these threats would be carried out if she were extradited. Stating that this situation poses a major danger in terms of human rights, the petition expresses that a temporary stay of proceedings by the court would be a critical decision.

The petition submitted by lawyer Herrmann states that there are many controversial legal points regarding Tok's extradition and that these issues must be addressed in detail in court. The petition highlights that there are significant legal questions regarding whether the charges against Tok fall under the scope of the extradition treaty between the US and Turkey, and emphasizes that the process should not be rushed.

The petition argues that issues such as whether the mobile phone Tok allegedly received constitutes evidence and whether the charges are consistent with the extradition treaty should be debated in court.

"NECESSARY DOCUMENTS SENT"

Following the extradition decision issued by the court, prosecutor Kristen Kearney entered a motion into the court system stating that all documents regarding the necessary certification and commitment for the extradition of Eylem Tok and her son Timur Cihantimur have been sent to the US Department of State. This development indicates that the process is officially moving forward and that the US Department of State will make the final decision. However, it is not yet known whether the court will accept the request for a stay.

If the court accepts Tok's request for a stay, her lawyers will be able to prepare an appeal and continue their legal battle to halt the process. However, if the court rejects this request, the extradition process is expected to accelerate, and Tok is expected to be sent to Turkey in the near future.

Judge Donald Cabell, who is presiding over the case, ruled on February 11 that the extradition of Timur Cihantimur and Eylem Tok to Turkey was appropriate and ordered the defendants to be handed over to Turkey under the Extradition Treaty currently in force between Turkey and the US.
