Prosecutor presents opinion in case of wrong medication given to MP İsmail Ok: Negligent injury

In the case opened in Ankara due to the administration of the wrong medication to AKP Balıkesir MP İsmail Ok, the public prosecutor has presented their opinion on the merits.

The hearing held at the Ankara 36th High Criminal Court was attended by the defendant Ali Akçay, his lawyers, and the defense counsel for the other defendants. It was stated in the reconciliation report submitted to the file that no agreement could be reached between the parties.

Presenting their opinion on the merits during the hearing, the public prosecutor stated that İsmail Ok, who was a 27th Term Member of Parliament at the time of the incident, had applied to the Private Koru Hospital in Ankara with complaints of an upper respiratory tract infection and was examined by the internal medicine specialist, defendant Ali Akçay.

The opinion explained that while Akçay intended to select the drug named 'Muscoflex', which is injected into the muscle, to be administered to the complainant Ok, he instead selected the drug named 'Muscobloc', which is administered intravenously and located below the other drug in the system, and recorded it in the order system.

The opinion stated that the drug 'Muscobloc' is not used in the treatment of upper respiratory tract infections, but is a drug used for muscle relaxation in general anesthesia and surgical procedures, which has the potential to cause a person's breathing and heart to stop. It was noted that İsmail Ok, who was directed to the emergency room for the administration of the medication, was given the drug intravenously by a nurse under the guidance of emergency medical technician Şevval Öcal.

It was stated that subsequently, Ok's heart stopped, he was resuscitated with CPR, and was later admitted to intensive care. In the opinion, it was assessed that Akçay's action did not constitute 'attempted intentional murder', but rather the crime of 'negligent injury in a manner that endangers a person's life'.

The prosecutor requested the acquittal of the hospital manager on trial, Mehmet Avcıküçük, stating that there was no evidence that he acted with the intent to conceal evidence of a crime.

The court panel, in its interim decision, ruled for the continuation of the judicial control measure of a travel ban for defendant Ali Akçay and granted the parties time to prepare their written defenses. The hearing was adjourned to September 24.
