Prosecutor's office appeals release decision in İZBETON case

The İzmir Chief Public Prosecutor's Office has appealed the decision to release 20 defendants, including former İZBETON General Manager Heval Savaş Kaya, who were arrested in the investigation into bid-rigging at İZBETON, a subsidiary of the İzmir Metropolitan Municipality.

While it was learned that Kaya will not be released from prison as he is a suspect in a separate cooperative case, it was learned that Buca Deputy Mayor Engin Güzel and Bayraklı Deputy Mayor Mehmet Mert Hanifi Yılmaz will be released.

Within the scope of the investigation conducted by the İzmir Chief Public Prosecutor's Office, an indictment was prepared and a public lawsuit was filed on July 16 against 44 suspects on charges of 'bid-rigging' and 'rigging the performance of an obligation' in tenders for 'asphalt paving, road and construction maintenance, repair, and renovation' works within the provincial borders.

The İzmir 28th Criminal Court of First Instance, which accepted the indictment, ruled in its preliminary report dated July 21 for the release of 20 detained defendants, including former İZBETON General Manager Heval Savaş Kaya, under judicial control conditions.

However, the İzmir Chief Public Prosecutor's Office filed an objection to the release decisions on the same day. The Chief Public Prosecutor's Office stated that the release of the defendants was unlawful in light of existing audit reports, expert reports, and evidence in the file, and requested that the decision be overturned.

HEVAL SAVAŞ KAYA'S DETENTION CONTINUES

Prior to this development, a release decision had also been issued for 31 detained defendants in a separate file regarding İZBETON's vehicle and heavy machinery rental services. Among these defendants were Heval Savaş Kaya, as well as Buca Deputy Mayor Engin Güzel and Bayraklı Deputy Mayor Mehmet Mert Hanifi Yılmaz.

In this case, heard by the İzmir 17th Criminal Court of First Instance, the İzmir Chief Public Prosecutor's Office immediately appealed the release decisions. It was learned that former İZBETON General Manager Heval Savaş Kaya, who was granted release in both files, will not be released from prison as he is a suspect in another investigation known as the 'cooperative file,' while Buca Deputy Mayor Engin Güzel and Bayraklı Deputy Mayor Mehmet Mert Hanifi Yılmaz will be released.
