Murat Ongun, the detained Chairman of the Board of IMM Medya A.Ş. within the scope of the IMM case, has submitted a petition to the Istanbul 40th High Criminal Court.
In his petition, Ongun stated that the majority of the accusations directed at him are based on witness accounts and statements given under the scope of 'effective remorse,' and expressed that there is no concrete evidence in the file. For this reason, he requested that the statements in question be taken with the aid of a 'lie detector'.
The petition submitted to the court also included details regarding the manner in which the indictment was prepared. Accordingly, it was noted that a single witness's statement with the same content was presented as evidence for 54 separate acts, and that in more than 40 acts, the statements of approximately 30 witnesses were repeated verbatim without any distinction. It was stated that this situation creates controversy regarding the accuracy and reliability of the statements in question.
The petition specifically emphasized that a polygraph is not a definitive means of proof that can be used as the sole basis for a verdict. Ongun stated that the purpose of this request is to test the internal consistency, sincerity, and reliability of the statements using an objective method.
In this context, Ongun expressed his explicit consent for his own statement to be taken with the aid of a lie detector and requested that the same method be applied to the witnesses who testified against him and the defendants who benefited from the provisions of effective remorse.
The defense recalled that the file was described even by the prosecution as the "investigation of the century." Attention was drawn to the importance of transparency and auditability in a case of this scale that has resonated widely with the public. Ongun stated that the polygraph request does not target any individual or institution, but is intended to demonstrate the will to reach the material truth.
The petition further pointed out that, by their nature, effective remorse and witness statements can be shaped by the expectation of a reduction in sentence or relief from liability, and therefore do not carry absolute reliability on their own. It was argued that reaching the material truth in criminal proceedings is possible through objective and verifiable methods rather than abstract narratives.
