RTÜK imposes maximum administrative fines on 2 digital platforms and 3 radio stations: 'Jasmine' discussed

RTÜK evaluated the broadcast violations of digital platforms and radio stations during its meeting held today. The institution imposedmaximum administrative fines on 5 broadcasting organizations. The report prepared regarding the series titled 'Jasmine',broadcast on the on-demand media service provider with the HBO Max logo,

was discussed during the Supreme Council meeting. Following the evaluation, the media service provider with the HBO Max logo was found to have violated the principle that broadcasts'cannot be contrary to the national and moral values of society, general morality, and the principle of the protection of the family,' as stated in clause (f) of the first paragraph of Article 8 of the Law No. 6112 on the Establishment and Broadcast Services of Radio and Television.for violating the provision, the maximumadministrative fine and removal from the catalogsanction was applied.

PENALTY FOR NETFLIX'S 'TOO HOT TO HANDLE: ITALY'PENALTY

At the Supreme Council meetingThe broadcast violations in the competition program titled 'Too Hot to Handle: Italy' by the on-demand media service provider Netflix were also addressed. It was determined that the program containedscenes contrary to thestructure of Turkish society,obscene scenes, and twistedrelationship networks. Consequently, the on-demand media service provider Netflix was found to have violated the provision stating that 'broadcasts cannot be obscene' as set forth in Article 8, paragraph 1, clause (n) of Law No. 6112 on the Establishment and Broadcast Services of Radio and Television Organizations,and was thereforesubjected to themaximum administrative fine.administrative fine at the maximum limit and removalfrom the catalogsanction was applied.

3 RADIO STATIONS FINED

At the Supreme Council meetingIn the media service provider organization named 'Radyo Lider İzmir', it was determined that messages sent by inmates in penal institutions and their relatives via SMS lines, voice recordings, or WhatsApp channelswere read,and requested songswereplayed. It was determined thatthis situation poses a risk to the order andsecurity of penal institutions.emphasizing that it is of a nature that could disrupt, and for these reasonsthe media service provider broadcasting under the name 'Rayo Lider İzmir' was issued a 3 percent administrative fine for violating the provision in Article 8, paragraph 1, clause (j) of Law No. 6112 on the Establishment and Broadcasting Services of Radio and Television, which states that 'Broadcasting services shall not contain elements that serve unfair interestsand lead to unfaircompetition'.was applied.

The media service provider named 'Radyomuğla' was found to haveIt was determined that songs containing coarse and slang language were broadcast on the program titled 'Kader MahkumlarıÖzel Programı' (Prisoners of Fate Special Program), which features music broadcasts aimed at convicts/detainees.The media service provider was sanctioned for violating Article 8, paragraph 1, clause (m) of Law No. 6112 on the Establishment and Broadcast Services of Radio and Television, which states: "Broadcast services must ensure that Turkish is used correctly, beautifully, and understandably, without distorting its features and rules;the use of the languagemust not bedistorted ormisused.vulgar, rude, and slang usagecannot be included" provision was violatedon the groundsthat a 3 percent administrative finewas issued.

‘Seç FM’ namedAnother media service provider organization was found to be broadcasting a program where requested songswereplayed andmessages were read for inmates held in penal institutions in the provinces of Manisa and Uşak, as well as their relatives. It was emphasized that the program shared information that could compromise the order andsecurityof the penal institutions. For this reason, it was determined that the station named 'Seç FM'The media service provider organizations were fined 2 percent for violating the provision in Article 8, paragraph 1, clause (c) of Law No. 6112 on the Establishment and Broadcasting Services of Radio and Television, which states that "Broadcasting services cannot be contrary to the principles of the rule of law,justice,andimpartiality."The administrative finewas applied.
