In the first hearing of the case in which bank branch manager Seçil Erzan and 6 defendants are being tried, held on November 21 at the Istanbul 41st High Criminal Court, it was decided to release the detained defendants Atilla Yörük and Nazlı Can.

'I COULD NOT GET RID OF SEMİH KAYA,' SHE HAD SAID

In her statement to the prosecutor's office, Erzan claimed that Semih Kaya and his manager Fırat Özdemir constantly threatened her by saying, "They won't let you live in Turkey, I have many connections, I know the head of the MIT, I know everyone in Turkey," and that they came to her house in Göktürk and said, "You cannot live here, we can do anything, we won't let you live."

Erzan stated, "It is true that I first received money from Semih Kaya with the promise of a fund. I received 3 million 200 thousand dollars from him. I received this money in pieces, sometimes in my office and sometimes outside. On one occasion, Ali Yörük received it from Semih Kaya. However, even though I paid back 5 million 700 thousand dollars, I could not get rid of Semih Kaya.

Semih Kaya told me, 'You have to pay this money.' I will get this money from you no matter what. I took the extra money I paid to Semih Kaya during that period from Emre Belözoğlu and Arda Turan. More precisely, I somehow took money from them with the promise of a fund and made payments to both of them to get rid of Semih Kaya and Fırat Özdemir," she had said.

11 PEOPLE TO BE HEARD AS WITNESSES

In its interim decision, the court ruled to issue a warrant to bring Semih Kaya, Kaya's manager Fırat Özdemir, Seçil Erzan's cousin Tanın Yılmaz and his wife Merve Yılmaz, Nur Erkasap, the wife of Müfit Erkasap who once served as Fatih Terim's assistant, her former boyfriend lawyer Candaş Gürol, Mustafa Sefa, Nilgün Arabacı, Gülsenal Bayramova, Oğuzhan Özerk and Bülent Onat to be heard as witnesses.

DEFENDANTS' PHONE RECORDS TO BE EXAMINED

The court also decided to request from the BTK the records of calls made, calls received, and base station logs for the last 6 months prior to the date of the crime regarding the defendants' phones. In line with the request of Erzan's lawyer, it was decided that the black Apple-branded phone with cracks found in the judicial repository should be given to an expert to identify evidence of the crime.

It was also decided to inquire with the prosecutor's office about the expert report resulting from the examination of Erzan's computer during the investigation phase.

19TH COMPLAINANT ADDED

When Mert Zeydanlı was added as the 19th complainant to the file, which already included 18 victims, the prison sentence requested for the defendant Seçil Erzan for the crimes of "Forgery of Private Documents" and "Fraud During the Commercial Activities of Merchants or Company Managers or Persons Acting on Behalf of the Company" increased from 69 years to up to 226 years.
