Second appeal filed against Ramazan Gülten's detention! 'Violation of the right to liberty'

The outcome of the second appeal against the detention of Ramazan Gülten, Head of the Istanbul Metropolitan Municipality (IMM) Department of Zoning and Urbanization, known for his struggle against illegal structures on the Salacak coast in Üsküdar, is being awaited. His lawyer pointed out that the legal process is moving slowly and that statutory time limits have been violated.

Ramazan Gülten, Head of the Department of Zoning and Urbanization, who became known to the public following an attack he faced during his struggle against illegal construction on the Salacak coast in Üsküdar, was arrested as part of the second wave of operations targeting the IMM.


SECOND APPEAL AGAINST DETENTION

Lawyer Ersöz stated in a post on his social media account that they have filed a second appeal against Ramazan Gülten's detention.

Ersöz noted the following:

"We have filed a request for the release of IMM Head of Zoning and Urbanization Department Ramazan Gülten. However, let us note that the 'objection to arrest' we filed 11 days ago has not yet been decided upon and the file has not been sent to the Duty Criminal Court of First Instance. Although the law stipulates that objections must be examined and decided upon within 3 days, keeping files waiting has become a general practice in Magistrate Criminal Courts…

Beyond this, our colleagues also state that there is a de facto practice in cases with multiple detained suspects of holding back objection petitions to be sent collectively to the same Criminal Court of First Instance. Even though Article 268/2 of the Criminal Procedure Code (CMK) states that Magistrate Criminal Courts shall send objection petitions to the Criminal Court of First Instance 'within 3 days,' the objection regarding Ramazan Gülten has been waiting before the Magistrate Criminal Court for 11 days. This situation in itself constitutes a violation of the Right to Liberty and the Right to an Effective Remedy."
