Statement from Yılmaz Tunç regarding the 387 individuals under investigation by the HSK!

The 5th Chamber of the Council of State had previously ruled that 450 individuals, who were dismissed from their professions on the grounds of being linked or affiliated with FETÖ, should be reinstated and also awarded compensation.

After AKP Chairman and President Recep Tayyip Erdoğan stated, "It is not possible for us to remain silent on this decision taken by the Council of State. Just as we do not remain unresponsive as the People's Alliance to some strange decisions made by the Constitutional Court, we cannot remain silent on this either. Furthermore, I cannot stomach these decisions made by the Constitutional Court," the Council of Judges and Prosecutors (HSK) launched a re-examination of the 387 individuals reinstated by the Council of State.

Speaking in Zonguldak, Minister of Justice Yılmaz Tunç said, "As the HSK, we have launched a new investigation regarding the 387 individuals (judges and prosecutors) who returned to their professions. As a result of this, these files will be re-examined."

Tunç continued as follows:

"In accordance with this decision, they returned to their professions. Of course, there are also files where the appeal process is ongoing in the Administrative Litigation Chambers of the Council of State. There are 64 files currently pending in the Council of State as the court of first instance, in the relevant chamber. Appeals are still ongoing for 1,286 of them. Regarding the files where lawsuits were filed, the Council of Judges and Prosecutors had made objections at that time, and appeal processes had been provided, especially for the 387 cases where reinstatement was decided. There are also files that are ongoing in the appeal process and have not been finalized. These decisions were made in periods covering various dates, approximately in the years 2021, 2022, and 2023, following these 387 reinstatement decisions. As the Council of Judges and Prosecutors, we have launched a new investigation regarding the 387 individuals who returned to their professions as a result of this decision. As a result of this, these files will be re-examined. Care is being taken to ensure there is no erroneous decision."

Emphasizing that they will never compromise on their determination in the fight against FETÖ, Tunç stated, "Because this is our red line. Just as we continue our fight against all terrorist organizations, we want this sensitivity to be maintained, especially in state institutions, particularly in places like the judiciary and the police, regarding FETÖ. Our President also made the necessary statements regarding the Council of State's decision in response to questions. Our Council of Judges and Prosecutors has also launched a re-examination of these files. If there are files that will turn into an investigation as a result of this examination, the authority that will decide on this is, of course, the Inspection Board of the Council of Judges and Prosecutors and the relevant chamber. We are all following the process together as a result of the Inspection Board's examinations."
