Strict intervention in the pharmaceutical sector by the Competition Authority: 42 million lira fine imposed

The Competition Board has imposed an administrative fine of 42.1 million lira on Menarini Sağlık ve İlaç Sanayi Ticaret AŞ and 35.7 million lira on Genveon İlaç Sanayi ve Ticaret AŞ. It was determined that both companies engaged in anti-competitive behavior, and the investigation was concluded through a settlement.

In a statement published on the Competition Authority's website, it was announced that the investigation conducted into the companies in question has been concluded.

The statement noted that within the scope of the investigation conducted by the Competition Board to determine whether Menarini Sağlık ve İlaç Sanayi Ticaret AŞ and Genveon İlaç Sanayi ve Ticaret AŞ violated the Law on the Protection of Competition, the companies submitted settlement texts.

The statement, which included the results of the settlement texts, recorded the following:

"It has been decided to impose an administrative fine of 42 million 148 thousand 808 lira on Menarini Sağlık ve İlaç Sanayi Ticaret AŞ on the grounds that it exchanged competition-sensitive information with its competitor and thereby violated the law, and an administrative fine of 35 million 722 thousand 195 lira on Genveon İlaç Sanayi ve Ticaret AŞ on the grounds that it engaged in an agreement/concerted practice with its competitors in the labor market by making 'gentlemen's agreements' not to hire each other's employees and thereby violated the law, and to conclude the ongoing investigation for the aforementioned companies through settlement."

OTHER FIRMS HAD ALSO BEEN FINED

On the other hand, the statement recalled that within the scope of the same investigation, administrative fines had previously been imposed on GlaxoSmithKline İlaçları Sanayi ve Ticaret AŞ in the amount of 33 million 321 thousand 564 lira, on Abdi İbrahim İlaç Sanayi ve Ticaret AŞ in the amount of 184 million 363 thousand 976 lira, on Bilim İlaç Sanayii ve Ticaret AŞ in the amount of 155 million 488 thousand 332 lira, and on Drogsan İlaçları Sanayi ve Ticaret AŞ in the amount of 30 million 593 thousand 234 lira, and that the investigation had been concluded through settlement for those companies as well.
