What happened?
On July 31, 2025, the Constitutional Court ruled that Kahraman's right to a fair trial, within the scope of the right to a fair trial, had been violated and ordered the case to be sent to the Istanbul 13th High Criminal Court for a retrial to eliminate the consequences of the violation of the right to a fair trial.
The Istanbul 13th High Criminal Court rejected the request for a "retrial" made following the Constitutional Court's (AYM) ruling of rights violation regarding Tayfun Kahraman.
In its rejection decision, the court claimed that the AYM, which had ruled that Kahraman's right to a fair trial was violated and that a retrial should be held by stating "there is no causal link between his actions and acts of violence," was "acting like a super-appeals court."
Kahraman, who suffers from MS, has been hospitalized several times due to attacks during his 4-year imprisonment and was sent back to prison after treatment.
