On September 2, in Ordu, physical education teacher Banu Kaya struck 1st-grade student Miray Arslan with her SUV, license plate 52 BK 790, as she entered the schoolyard during the orientation week. While Miray was critically injured, medical teams were dispatched to the school following reports from staff. Miray Arslan, the daughter of Eda and Yakup Arslan, was taken to Ordu Training and Research Hospital after initial intervention by medical teams. Despite treatment, Miray could not be saved. Following the incident, teacher Kaya was arrested by the court after her procedures at the police station.
TRIAL CONTINUES
The third hearing of the case in which Banu Kaya is being tried at the Ordu 5th Criminal Court of First Instance was held today. Banu Kaya attended the hearing, where she appeared as a defendant, via the Audio and Visual Information System (SEGBİS) from the Efirli E-Type Prison, where she is being held. The couple Eda and Yakup Arslan, their lawyers, and the defendant's lawyer also attended the hearing.
‘IT HAS OPENED A DEEP WOUND IN THE PUBLIC CONSCIENCE’
Banu Kaya, who is being tried for "causing death by conscious negligence" with a requested prison sentence of 2 to 6 years, requested her release at the third hearing of the case, saying, "I am very sorry; I also have 2 children. They are also preparing for exams. My children and my students need me."
APOLOGY DEEMED INSINCERE
The plaintiff's lawyer stated that teacher Banu Kaya did not take any precautions during the incident and disregarded the rules, arguing that she committed the crime not with conscious negligence, but with probable intent. Upon defendant Banu Kaya's apology and statement that she was sorry, the plaintiff's lawyer expressed that he found the apology insincere, stating, "An apology that can only be uttered at this stage out of impulse has opened a deep wound in our family and the public conscience. These words are more grave than the incident itself."
Upon this, defendant teacher Banu Kaya took the floor and said, "I have never had any criminal record until now. My dialogue with children is also known by everyone. I do not accept the accusations that I am insincere."
REACTION FROM MİRAY’S FATHER TO RELEASE REQUEST
Following the defendant's request for release by saying, 'My children and my students need me,' Yakup Arslan, the father of Miray Arslan who died in the accident, reacted by saying, "She requests release by saying she has children, and she smiles while saying this. Where is my child? She says she is waiting for her children at home. You violated everything. Now you say my children are waiting at home."
The court panel, having heard the parties, decided to continue the detention of defendant Banu Kaya and adjourned the hearing.
