Union of Turkish Bar Associations reacts to Court of Cassation's criminal complaint against Constitutional Court members

The Union of Turkish Bar Associations has reacted to the Court of Cassation's decision to file a criminal complaint against members of the Constitutional Court following the latter's 'violation of rights' ruling.

The Union of Turkish Bar Associations, in its statement regarding the Court of Cassation's filing of a criminal complaint against Constitutional Court members, stated: ''The decision to file a criminal complaint against members of the Constitutional Court is an attempt to change the constitutional order.''

''IT IS AN ATTEMPT TO CHANGE THE CONSTITUTIONAL ORDER''

The statement from the Union of Turkish Bar Associations is as follows:

''The decision taken today by the 3rd Criminal Chamber of the Court of Cassation, following the violation ruling issued by the Constitutional Court in the application of Ş. Can Atalay, to 'not comply' and to file a criminal complaint against the members of the Constitutional Court is an attempt to change the constitutional order.

The Chamber's decision, which effectively accuses the Constitutional Court of acting in concert with terrorist organizations, attempts to discipline the supreme Grand National Assembly of Turkey—which represents the will of the nation—and uses language unbecoming of a judicial authority issuing a ruling in the name of the Turkish Nation, marks a turning point for a state governed by the rule of law where the principle of the supremacy of law prevails.

The members of the Court of Cassation who signed this decision should be immediately invited to withdraw from their duties, and a criminal investigation should be initiated against them by the First Presidency Board of the Court of Cassation.

Our Union will make the necessary application to the High Disciplinary Board of the Court of Cassation as of tomorrow to implement the sanction of 'invitation to withdraw from duty' regarding the relevant Court of Cassation Chamber members who disregard the constitutional order. A decision has been made to hold an extraordinary meeting tomorrow morning to determine the actions to be taken in consultation with our bar associations in order to protect the rule of law and the rights of our citizens against this arbitrary, constitution-defying practice.

The Union of Turkish Bar Associations, which has stood firmly against every type of coup attempt to date, will never hesitate to fulfill its duty to protect the democratic state governed by the rule of law.''
