Urban transformation bill accepted in the Turkish Parliament

The Law Proposal on the Amendment of the Law on the Transformation of Areas Under Disaster Risk and Certain Laws and Decree-Law No. 375 has been accepted in the General Assembly of the Turkish Parliament.

According to the proposal, new procedures are being introduced to the Administrative Procedure Law for cancellation lawsuits filed against administrative actions established based on damage assessment reports, excluding transactions related to property rights. Deadlines for conducting site inspections and submitting expert reports are being shortened.

The court is given the discretion to decide whether to hold a hearing, even if requested by the parties; it is mandated that cases be decided within 15 days at the latest from the completion of the file or, in cases where an interim decision, site inspection, expert examination, or hearing is required, from the completion of these processes.

15-DAY PERIOD WILL BE GRANTED

An Urban Transformation Presidency will be established, and the Presidency will have a special budget. Changes are being made to ensure that the duties, rights, and powers regarding the identification of risky structures and the allocation of Treasury immovable properties to the Ministry for evaluation will henceforth be exercised by the Urban Transformation Presidency.

With the proposal, a regulation is being made in the law to allow for financial assistance to be provided to property owners for construction, in order to implement the 'half is on us' campaign launched to accelerate transformation in Istanbul.

The decision taken by the majority of owners, along with the proposal containing the terms of the agreement, will be notified to the owners who did not participate in the majority decision via a notary or by being posted at the relevant neighborhood headman's office (muhtarlık) for a period of 15 days.
