Verdict reached for boyfriend in case of Ayşe Özgecan Usta, who died after falling from 8th floor

In Zonguldak, 28-year-old Ayşe Özgecan Usta lost her life 3 years ago after falling from the terrace of an 8th-floor building in the İncivez neighborhood.

Following the incident, her boyfriend, Bartu C.A., began to be tried on charges of 'causing death by negligence and deprivation of liberty.'

Bartu C.A., who was being tried without arrest, did not attend the final hearing held at the 2nd Criminal Court of First Instance. During the hearing, which was attended by Özgecan Usta's father, Kenan Usta, and the lawyers for both parties, the Public Prosecutor presented his opinion.

The prosecutor requested that the defendant, Bartu C.A., be punished for the crime of deprivation of liberty, but acquitted of the charge of causing death by negligence.

Speaking against the prosecutor's opinion, father Kenan Usta said, "My daughter's phone was found the next day, broken. An unlicensed walkie-talkie was seized there. Unlicensed ammunition was seized, and no action was taken. If he had let my daughter go out to the street, she wouldn't have had a breakdown and gone there (to the balcony). The person created the cause. There is a cause here. Why did he make my daughter drink when he didn't drink himself? He called her to reconcile, but she didn't want to."

Kenan Usta's lawyer, Ezgi Aybüke Dizlek, also stated that they did not accept the prosecutor's opinion, saying, "She was already crying in the bathroom for an hour after the act of deprivation of liberty. She was packing her bag. She was getting dressed. She was preparing to leave.

She was asking her friend for money. She went out to the balcony. She went back inside and they argued. She wanted to go out to the balcony again. There is not even two meters of distance between the balcony threshold and the armchair. Her psychological state can be estimated more or less. If this were your girlfriend, you would have more information than the (expert) reports.

Bartu C. is a person of this competence. According to his statement, he sat in the armchair without attaching any reality to her saying she would throw herself. It is a grave situation that he did not consider the possibility. Ayşe went out with her face turned toward Bartu C.

Is it possible for a person who wants to jump to go out there with their face turned toward the room? According to the neighbors' statements, he went downstairs 3-5 minutes after Ayşecan fell. First, he got dressed. He was so cold-blooded that he collected the phones. He hid the phones. He knocked on the neighbor's door. Then he went downstairs.

The police arrived. Then he wanted to leave the scene. We do not accept the prosecutor's opinion. When all these points are put together, it is impossible for negligence not to have occurred. While we are talking about intent, we are discussing whether negligence occurred or not," she said.

The lawyers for the defendant, Bartu C.A., requested his acquittal on both charges of causing death by negligence and deprivation of liberty.

The judge decided to acquit the defendant of both charges.

"WE WILL APPEAL"

After the hearing, father Kenan Usta reacted to the decision, and his lawyer, Ezgi Aybüke Dizlek, announced in a statement to reporters that they would file an appeal.

Dizlek said, "The honorable court decided to acquit him on both charges. We will appeal the decision. It is impossible to agree with either the prosecutor's opinion or the verdict."
