Wanted via Red Notice: Deportation of Mutairi, who supports jihadist organizations, overturned by the Constitutional Court

The Afyonkarahisar Administrative Court had issued a deportation order for Kuwaiti national Hakem Al Mutairi, who is on the terror lists of Saudi Arabia, Egypt, and the United Arab Emirates and is wanted via a Red Notice.

In its decision, the Afyonkarahisar Administrative Court stated that Mutairi was wanted for the crime of financing terrorism and emphasized the following:

“Finding his presence on national territory to be objectionable in terms of Turkey's general security, and in accordance with the provision regulating the deportation of those who 'pose a threat to public order, public security, or public health' within the state's sovereign authority, no illegality was found in the subject matter of the lawsuit regarding his deportation.”

CONSTITUTIONAL COURT STAYED THE DEPORTATION ORDER

The decision issued by the Afyonkarahisar Administrative Court regarding Mutairi was overturned by the Constitutional Court on June 12.

In its ruling, the Constitutional Court decided to stay the order for Mutairi's deportation.

The Constitutional Court's decision included the following statements:

“In this specific case, information and documents are needed to evaluate whether there is a serious threat to the applicant's life or physical and moral integrity. The execution of the deportation process would lead to irreparable consequences.”

SUPPORT FOR JIHADIST ORGANIZATIONS IN SYRIA

In 2011, following the death of Osama bin Laden, Hakem Al Mutairi published a statement congratulating the Al-Qaeda leader for his jihad against the West. Mutairi also has ties to Abdul Rahman bin Omair Al-Nuaimi, who is among the Al-Qaeda financiers on the sanctions lists of the United Nations and the United States. Since 2006, Mutairi has served as a member of the Board of Trustees of the Global Campaign to Resist Aggression, which is chaired by Al-Nuaimi.

Hakem Al Mutairi also has close ties to Hajjaj bin Fahd al-Ajmi, a Kuwaiti national who provided financial support to Al-Nusra, one of the jihadist groups in Syria. In a statement, Hajjaj bin Fahd al-Ajmi claimed that Mutairi had given him 300 thousand dollars to help jihadist groups in Syria. Ajmi is considered a terrorist by the US, the UN Security Council, Egypt, the UAE, and Saudi Arabia, and is on Interpol's wanted list.
