'We will build a school' was the promise, but a luxury villa emerged: Construction under investigation

In the Bodrum district of Muğla, a plot of land designated for public social and cultural use was sold to a private company. The construction project, which turned out to be a luxury villa instead of a school, has been placed under investigation.

In the Konacık neighborhood in the city center of Muğla's Bodrum district, a plot of land designated for public social and cultural use was sold to a private company. 

According to a report by Yaşar Anter from Sözcü Newspaper, local residents took to the streets and held multiple protests after learning that a 5-story luxury villa was being built on the site where they were told a school would be constructed. It has emerged that the Governor's Office launched an investigation into the matter following the news reports.

Months later, it was revealed that the Muğla Governor's Office, through the Provincial Directorate of Environment, Urbanization and Climate Change, had opened an investigation and forwarded the file to the Bodrum Municipality.

The Governor's Office provided the following information in its statement:

-Regarding the allegations concerning the structures being built on plot 2316 in Konacık Neighborhood (Çırkan), Bodrum District, technical examinations and inspections are to be conducted on the projects, on-site, and within the files held at the Bodrum Municipality, in accordance with Zoning Law No. 3194, relevant regulations, the current zoning plan, plan provisions, and all applicable legislation.

-It was determined that while the structures on the property at plot 2316 in Konacık Neighborhood, Bodrum District, were built in compliance with the permits issued by the Bodrum Municipality, the building permits and their attached architectural projects were issued in violation of current zoning legislation, the zoning plan, and plan provisions.

The details of the incident, as stated in the conclusion of the report, were listed one by one:

-The requirements for a minimum area of 15,000 m2 for a Social-Cultural Facility Area and a minimum of four functional requirements were not met.

-When the 1309.21 m2 area that should have been included in the floor area ratio (FAR) calculation for basement floors and terrace roofs was included, the FAR limit was exceeded by 1237.08 m2.

-It was stated that "the building footprint usage in these areas cannot exceed 40 percent of the area and the maximum building height cannot exceed 6.5 meters (2 stories)." Measurements showed that the height (13 meters) was in violation of the plan provisions.

Regarding the Building Height, it was concluded that "in accordance with the provision in the 7th clause of Article 28 of the 'Planned Areas Zoning Regulation,' which states: 'Each is determined by the decision of the architectural aesthetics commission according to technological and architectural requirements,' no height exceeding 6.50 meters could be created without such a decision, and no such decision was found during the examination of the file; therefore, it was concluded that the issued building permits and their attached architectural projects were prepared in violation of current zoning legislation, the zoning plan, and plan provisions."
