The Savings Deposit Insurance Fund (SDIF) has announced that the franchise (brand leasing) agreement for the new branch opened by the company of the imprisoned Dilan Polat was signed before the appointment of a trustee, and that beauty centers for which no trustee has been appointed by the court are not managed by the SDIF.
In the statement issued by the SDIF, it was stated that a clarification became necessary due to misinformation in recent news reports regarding the trusteeship duties.
The statement noted that while legal proceedings are ongoing for some of the companies under investigation, courts may appoint the SDIF as a trustee to ensure that commercial activities continue in accordance with the law without interruption, and to protect the economy and employment. The following was recorded:
"The primary duty of the SDIF in the companies entrusted to it is the payment of public debts and the protection of employment and the claims of third parties. Before the appointment of a trustee, the Polat Group companies signed franchise agreements with numerous companies both domestically and abroad. Of the more than 100 companies with which such agreements were signed, only 5 are subject to a trusteeship decision. Beauty centers other than these are not 'agents' or 'representatives' of the Polat Group companies; they conduct their commercial activities on their own behalf and for their own account. In other words, while companies and beauty centers for which no trustee has been appointed by the court are not managed by the SDIF, the mutual rights and obligations of the parties under the franchise agreements continue."
The statement advised against giving credence to unfounded news reports and urged that only statements issued by the SDIF regarding the matter should be followed.
