Crypto barrier from the CMB: Entities and individuals unable to provide services identified

According to the statement made by the CMB, the latest status regarding the applications of those wishing to obtain an operating license as a crypto asset service provider was conveyed following the regulation published in the Official Gazette on July 2, 2024.

The following information was provided in the decision included in the CMB's weekly bulletin:

"In accordance with Articles 35/B and Provisional Article 11 added to the Capital Markets Law No. 6362 (the Law) by the Law on Amendments to the Capital Markets Law No. 7518, which was published in the Official Gazette dated 02.07.2024 and numbered 32590, regarding the applications of those who declared to our Board that they are operating or will operate as crypto asset service providers;

(a) Pursuant to Article (2) of the section titled "Transitional and Harmonization Provisions" of the Board Principle Decision dated 08.08.2024 and numbered 42/1259, published in our Board's Bulletin dated 08.08.2024 and numbered 38, the applications of the platforms listed below in the "List of Platforms Whose Applications Have Been Removed from Processing" are to be removed from processing due to the incomplete or insufficient submission of the explanations and documents requested in items (3) and (4) of the document list in Annex/1 of our Board's announcement dated 02.07.2024, and are to be announced together with the "List of Platforms Whose Applications Were Not Accepted for Processing" within the scope of Article (1) of the aforementioned Principle Decision,

(b) The platforms included in the lists are required to terminate activities that fall under the definition of a platform in accordance with the Law within 5 business days following this Board Decision, not to accept new customers following this Board Decision, to notify their existing customers regarding the matter via electronic mail, text message, telephone, and similar communication tools in accordance with the first and second paragraphs of the Provisional Article 11 of the Law, and to fulfill their customers' cash and/or crypto asset transfer requests without the 5-business-day restriction,

(c) It has been decided to remind that in the event of continuing activities and customer acceptance contrary to the principles contained in clause (b) above, or failure to fulfill customers' transfer requests, the provisions regarding unauthorized crypto asset service provider activities may be applied within the scope of Articles 99/A and 109/A of the Law."
