The Ministry of Trade has taken action to establish an effective market surveillance and inspection mechanism for products sold online, announcing the E-Commerce Product Safety Project. According to information compiled from the Ministry of Trade's Market Surveillance and Inspection Report, the development and spread of the internet have created an electronic market with dynamics and rules different from traditional shopping channels.

E-commerce has increasingly become the preferred choice for consumers, but this field has emerged as a new form of trade that is not very easy to regulate.

RULES HAVE BEEN SET

With the "Law on Product Safety and Technical Regulations," prepared to address the need for a legal infrastructure in this area, rules have been established for the effective inspection of products subject to the increasingly widespread e-commerce in Turkey.

The "Draft Regulation on Market Surveillance and Inspection of Products Offered to the Market via Remote Communication Tools," prepared as secondary legislation for the law, has also been presented for public opinion.

The draft aims to ensure that products offered to the market via remote communication tools such as the internet and telephone can be inspected upon complaint or ex officio, that operators cooperate with the authorized bodies conducting the inspections, and that authorized bodies can obtain samples through undercover purchases when necessary for inspection.

AWARENESS AIMED TO BE INCREASED

On the other hand, the E-Commerce Product Safety Project will also be carried out by the Ministry.

The project aims to strengthen the infrastructure of market surveillance and inspection bodies in the field of product safety inspections in e-commerce, and to increase the awareness of both producers selling products in electronic environments and consumers regarding product safety.

Furthermore, it aims to ensure effective coordination in electronic commerce inspections and to establish an effective inspection system by developing software that enables market surveillance and inspection in electronic commerce.

Goals regarding the issue were also included in the 2024 Presidential Annual Program.

Accordingly, a system will be established to activate market surveillance and inspection in e-commerce, and necessary legislative regulation efforts will be carried out. Secondary legislation regarding the market surveillance and inspection of products offered to the market via remote communication tools will be completed.
