The Ministry of Trade has prepared a "Draft Regulation on Amendments to the Regulation on Real Estate Trade."
The regulation aims to eliminate difficulties encountered in the implementation of the current regulation, which was published in the Official Gazette in 2018, and to meet the demands and expectations of industry representatives.
Within the scope of the draft, which has been submitted for the opinions of relevant institutions and organizations, adjustments will be made to the requirements for real estate businesses operating or wishing to operate in real estate trade to obtain an authorization certificate.
Accordingly, in order to prevent real estate businesses that cannot meet the professional experience requirement from operating without an authorization certificate, despite meeting other necessary conditions, and to resolve issues in the sector regarding this matter, the professional experience requirement will be abolished.
REGULATION ON REAL ESTATE LISTINGS
Regulations are also being introduced regarding obligations for online listings. In this context, individuals or legal entities providing electronic environments for listings related to the sale of properties belonging to others will not be permitted to allow multiple listings for the same property at different prices.
In this way, it is aimed to prevent speculative price increases and to eliminate information pollution in listings on platforms providing services in the electronic environment.
Depending on the nature of the offense, various amounts of fines will be applied in accordance with the relevant laws for listings posted in violation of the rule.
On the other hand, the rule regarding the conditions for granting an authorization certificate, which states that one must "not have received a final prison sentence of more than 5 years for an intentionally committed crime," will be changed to "not have received a total of 5 years of final prison sentences for intentionally committed crimes."
The implementation of administrative fines for those conducting real estate trade activities without an authorization certificate will be transferred to provincial directorates.
