Public disclosure penalty for 'tax evaders' enters into force: Names will be announced online

According to the General Communiqué on the Tax Procedure Law published in the Official Gazette, the names of taxpayers with tax debts or penalties of 5 million Turkish Lira or more that are past their due date will be announced at tax offices across Turkey between October 15-31, 2024, and on the Revenue Administration's website between November 1-15, 2024.

The General Communiqué on the Tax Procedure Law by the Ministry of Treasury and Finance (Revenue Administration) has been published in the Official Gazette and has entered into force.

Accordingly, the names of taxpayers with tax and penalty debts of 5 million Turkish Lira or more that remain unpaid despite being past their due date will be disclosed.

In this context, lists containing taxpayer information will be published at all tax offices across Turkey between October 15-31, 2024, and on the Revenue Administration's website between November 1-15, 2024.

According to the communiqué published in the Official Gazette, pursuant to the authority granted to the Ministry of Treasury and Finance by the fourth paragraph of Article 5 of Law No. 213;

a) The disclosures to be made in 2024 shall be carried out by posting them in areas designated for public announcements at tax offices across Turkey between 15/10/2024 and 31/10/2024 (inclusive), and on the Revenue Administration's website between 1/11/2024 and 15/11/2024 (inclusive),

b) Taxpayers with debts of 5,000,000 TL or more to any individual tax office, or those with finalized tax and penalties of this amount or more, shall be included in the scope of the disclosure,

c) The disclosure shall take into account tax and penalties that were due as of 31/12/2023 but remained unpaid as of 30/9/2024, which are specified as being within the scope of disclosure by the General Communiqué on the Tax Procedure Law (Serial No: 293), as well as assessments finalized between 1/6/2023 and 31/5/2024,

ç) The principles determined by the General Communiqué on the Tax Procedure Law (Serial No: 293) shall be followed regarding the information to be disclosed, the location of the disclosure, and other matters; however, regarding the addresses to which the lists prepared under section III/B titled "Disclosure in the Internet Environment" of the same Communiqué are to be sent, it has been deemed appropriate for the Defterdar offices to send the lists prepared according to section (I-A) of the General Communiqué on the Tax Procedure Law (Serial No: 293) to the Revenue Administration's Department of Revenue Management (IV), and the lists prepared according to section (I-B) to the Revenue Administration's Department of Collection and Disputed Matters, in electronic format as an attachment to an official letter.

MEHMET ŞİMŞEK HAD SAID 'I AM WARNING FOR THE LAST TIME'

Minister of Treasury and Finance Mehmet Şimşek had announced yesterday that they continue to take steps to strengthen justice in taxation and that they would share with the public the names of taxpayers who have tax debts and penalties of 5 million Turkish Lira or more at any individual tax office.

Stating that they have implemented various regulations as a government in this direction, Şimşek had used the following expressions: "We continue to take steps to strengthen justice in taxation. We have given instructions for the publication of lists of taxpayers who have tax and penalty debts that remain unpaid despite being past their due date. We will share with the public the names of taxpayers who have tax debts and penalties of 5 million Turkish Lira or more at any individual tax office."
