An important change has been implemented in inheritance law, which closely concerns millions of our citizens in our country. With the long-awaited regulations, fundamental innovations have been made in title deed transactions regarding the distribution of inheritance.
The new regulation was created with the aim of preventing family disputes in particular and granting more flexibility to heirs.
While it was previously mandatory for the inheritance to be distributed equally, this rule has been abolished with the new regulation. As a result, family members will be able to determine their inheritance shares more flexibly by making written agreements among themselves.
With the new regulation, real estate transfer transactions between siblings have also been significantly simplified. Siblings will now be able to transfer real estate to each other through written agreements without the need for notary approval. In this way, heirs will be able to carry out property sharing among themselves quickly and practically.
An important change has been made regarding shared title deeds. According to the new regulation, the joint decision and direct participation of all shareholders in the transaction have become mandatory for the sale of a shared property. However, shareholders can be exempted from the obligation to participate in the transactions by granting power of attorney to a lawyer.
In previous regulations, the principle of equal distribution of inheritance caused many disputes within families. With the new regulation, this principle has been replaced by allowing parties to reach a consensus among themselves through written agreements.
