Nevzat Bahtiyar detail in Narin Güran murder investigation: Simultaneous raids!

The investigation into the death of Narin Güran, who went missing on August 21 in Tavşantepe Village in the Bağlar district of Diyarbakır and whose body was found on September 8 in a creek bed 2 kilometers from the village, has been expanded.

According to a report by Özgür Cebe from Sözcü; while an expert report from TÜBİTAK is awaited regarding footage showing two other individuals at the scene during the hours when the confessor Nevzat Bahtiyar, who buried the young girl on the day of the murder, was at the creek bed, gendarmerie teams carried out simultaneous operations on several houses in neighboring villages.

SIMULTANEOUS RAIDS CONDUCTED ON TWO NEIGHBORING VILLAGES

Simultaneous raids were carried out on the homes of the first-degree relatives and relatives of confessor Nevzat Bahtiyar, as well as his son's home, in the village of Gönenli and the town of Çarıklı, which are neighbors to Tavşantepe Village.

Acting on a search and seizure warrant issued by the duty Magistrate Judge of Criminal Peace, the gendarmerie searched the homes and, under the instructions of the prosecutor's office, seized certain digital materials and items deemed suspicious that could serve as evidence for further examination.

According to information reflected in the investigation file, it was noted that Nevzat Bahtiyar's brother, A.B., was present in the village on the day and at the time Narin went missing, despite not residing in the village and having no business there.

SUSPICIOUS QUESTIONS AND THE VILLAGE ON THE DAY OF THE INCIDENT

It has been reported that there are witness statements and some camera footage regarding this.

It was noted that Bahtiyar's brother closely followed the search operations in the village in the days following the incident, constantly monitoring which direction the soldiers were searching, and frequently displayed uneasy and suspicious behavior toward the little girl's family and relatives, asking, "Where did the soldiers look? Did they check the creek too? Which places were searched, have they been able to find anything?"

It was also reported that raids were conducted on the homes belonging to his son and relatives in two neighboring villages, as Nevzat Bahtiyar's wife had also been constantly saying in the village after the little girl went missing, "We are leaving here anyway. We are going to settle in Istanbul."

HAWK-EYE CAMERA HAD DETECTED IT

It was determined that Nevzat Bahtiyar, whose vehicle was seen parked stationary in the creek bed for 50 minutes between 15:40 and 16:30 on the day of the incident, was captured on hawk-eye camera footage driving his vehicle along the stabilized road toward the direction of the Çarıklı township after burying the body, and subsequently going to his son's house, who resided in that same township, on the same day.

FILE SENT TO JUDGE AS DETENTION REACHES 1 MONTH

Meanwhile, as uncle Salim Güran’s detention reached its one-month mark yesterday following his arrest on September 2, the three prosecutors conducting the investigation sent the file to the on-duty Criminal Court of Peace, as a monthly review of detention is mandatory under the Criminal Procedure Code (CMK).

The duty judge, having examined the file in its entirety along with the evidence, noted that the expert report expected from TÜBİTAK regarding the analysis, as well as the report expected from the Van Gendarmerie Criminal Laboratory concerning whether any DNA findings belonging to the arrested suspects were present in samples obtained from the house, vehicle, and certain items, had not yet been submitted to the file.

The Criminal Judgeship of Peace stated that the evidence had not yet been fully collected and that there was a possibility at this stage that the uncle, Salim, could flee, tamper with evidence, or exert pressure on witnesses.

It was noted that he fell into contradictions in his statements given to the Gendarmerie, the prosecutor's office, and the questioning judge.

In its ruling, the court decided to continue his detention, citing that it was established by an expert report that the stain found on the seat of the vehicle used exclusively by Salim contained Narin's DNA, and noting that he had deleted call logs and WhatsApp messages from his phone immediately after the incident, and that the investigation is ongoing.

DETENTION CONTINUED, CASE RETURNED TO PROSECUTOR

The ruling emphasized that when the entire scope of the file is examined as a whole, the valid grounds for suspicion stipulated in Article 5 of the European Convention on Human Rights, the strong evidence required by Article 19 of the Constitution, and the concrete evidence stipulated in Article 100/1 of the Criminal Procedure Code (CMK) are present.

It was stated that the measure of detention is proportionate, taking into account the lower and upper limits of the penalty prescribed for the crime, the fact that the crime is among the catalog crimes, and the high probability of flight given the expected sentence.

The Criminal Judgeship of Peace decided to continue the detention, stating that judicial control measures such as house arrest and a travel ban would be insufficient at this stage, and returned the file to the three prosecutors conducting the investigation.

APPEALS AGAINST DETENTION FOR 11 PEOPLE ALSO REJECTED

On the other hand, lawyers for 10 members of the Güran family, including Narin's mother and brother, as well as the confessor Nevzat Bahtiyar, filed appeals against their detention status.

Reviewing these appeals, the Criminal Judgeship of Peace decided to reject all requests for release and ruled that the suspects should remain in detention based on the current state of evidence.
