The dispute within the AKP over the release of the youth: There are differing views within the party... 'They might come out as creditors'

The arrest of IMM Mayor and CHP presidential candidate Ekrem İmamoğlu and the imprisonment of young people have become the most discussed issues of recent days. As a result of inquiries made in government corridors regarding the subsequent judicial process, comments were made that it was 'far from ideal and legal'.

Nefes columnist Nuray Babacan reported on what is being discussed in AKP corridors. According to Babacan, despite differing opinions within the party, the perspectives of those directly involved in the process are as follows;

- No result is expected from the judicial process regarding İmamoğlu and his team from one day to the next. Comments are being made that 'releasing them politically in the near future would create the impression that the mountain labored and brought forth a mouse, and they do not want this.' It is understood that the mise-en-scène built on corruption allegations will be maintained.

- The most interesting comment for us was about the presiding judges. It is also being said that the presiding judges are influenced by the climate and the ground, and that they avoid making decisions contrary to the general atmosphere.

- A politician commented, "There doesn't have to be pressure. Decisions are heavily influenced by the current climate. As long as the wind is not blowing in the direction of Ekrem İmamoğlu's release, no presiding judge would dare to do so."

Meanwhile, there have been discussions behind closed doors regarding the process of releasing the young people. Specifically, from a legal standpoint, the sentence to be given by the court should coincide with the time already served in prison.

However, the crime attributed to the young people due to their actions does not carry a prison sentence. If the time they spend inside is extended, they could end up as creditors according to the penal code. This has other legal consequences as well.

According to the enforcement law, if they have not harmed anyone, you cannot keep a suspect in custody for crimes that do not carry a prison sentence. For crimes without custodial enforcement, they become creditors for every day they remain inside.

This is becoming a subject of debate both in the courthouse and at the ministry. It is expected that all individuals who participated in the protests will be released with this approach. Except for those involved in incidents of injury...

WHAT HAPPENED?

Within the scope of the operation conducted against the IMM, CHP's presidential candidate and IMM Mayor Ekrem İmamoğlu was arrested on allegations of 'corruption'. İmamoğlu is currently being held in Silivri Prison.

Before his arrest, 6 investigations had been launched against İmamoğlu. İmamoğlu's diploma was cancelled 1 day before his arrest. CHP Chairman Özgür Özel had claimed that all the accusations made were political.
