Details of the 8th judicial package sent to the Presidency have emerged.

According to the draft text, which amends 105 articles in 22 different laws, the lower and upper limits for judicial fines per day will be increased. Claims for non-pecuniary damages will be directed to the Compensation Commission instead of the Constitutional Court. Probation criteria will also be changed.

JUDICIAL FINES

According to a report by Ebru Karatosun from Hürriyet, the draft of the new judicial package proposes increasing the lower limit of the judicial fine per day from 20 liras to 100 liras, and the upper limit from 100 liras to 500 liras. The finality threshold for judicial fines imposed directly by courts will be raised from 3,000 TL to 15,000 TL.

COMPENSATION COMMISSION

Claims for non-pecuniary damages will be directed to the Compensation Commission instead of the Constitutional Court. These regulations will apply to decisions rendered after April 1, 2024.

PROBATION

Instead of applying a 1-year probation period to every convict, it will be applied proportionally to the sentence. Accordingly, a convict will remain in a penal institution for at least 40 percent of their sentence. This means that a person sentenced to 1 month will remain in a penal institution for 12 days. The probation period will not exceed 3 years.

AMENDMENT TO THE TURKISH CIVIL CODE

In line with the Constitutional Court's annulment decision, the article in the Turkish Civil Code requiring women to take their husband's surname will be revised. Mothers will be granted the right to file a lawsuit to deny the lineage between the father and the child.

LEGAL PROFESSIONALS AND CONCILIATION TALKS

Legal professionals with 20 years of seniority in their profession will be able to become mediators without taking an exam. Compensation lawsuits may be filed for damages that were not identified during conciliation talks or that emerged after the conciliation.

CONDITIONAL RELEASE CONDITION

Convicts subject to recidivism provisions for the second time will be able to benefit from conditional release if they spend three-quarters of their fixed-term imprisonment in a penal institution with good behavior.

CRIME OF INSULT

The act of committing the crime of insult via audio, written, or visual communication will be removed from the scope of conciliation and included in the scope of advance payment. Furthermore, the complaint period for the crime of insult, which is subject to a complaint, will not exceed 1 year.

COMPENSATION CLAIMS OF THE HIGH CRIMINAL COURT

Appeals can be made against decisions rendered by the High Criminal Court regarding compensation claims. Decisions made by the regional court of justice on this matter will be final.
