Footage that surfaced following an operation conducted on October 1 against the Mersin Metropolitan Municipality has sparked controversy. The footage shows the moment police teams arrived at a home for a detention procedure and encountered a woman who opened the door in her pajamas.
In the footage, which was reportedly filmed at dawn, it was seen that the police entered the home after the door was opened, and the woman appeared surprised upon seeing the teams. The focus of the controversy is not the operation itself, but rather the fact that the woman was filmed in her private, unprepared state and that this footage was leaked to the press.
Politicians expressed their reactions to the publication of the footage in posts on their social media accounts. Gökçe Gökçen stated that it is unacceptable for a woman to be filmed in her home in her pajamas, criticizing the release of the footage to the public.
“How will women be safe in this country when the police film a woman in her home in her pajamas, the police respond to the woman saying ‘could you turn that off’ by saying ‘it’s no problem, it’s for informational purposes,’ and the ministry leaks the footage to the press?”
Sibel Suiçmez also argued in her post that the filming and publication of the video are incompatible with the principles of a state of law. Seyit Torun criticized the filming and leaking of a woman during a search conducted in the early morning hours with the words, “Shame on you.”
LEGAL DIMENSION HIGHLIGHTED
Mahmut Tanal evaluated the publication of the footage in terms of the confidentiality of the investigation, the protection of private life, and the inviolability of the home. Tanal stated that entering a home as part of an investigation does not mean that the privacy of that home can be recorded and leaked to the press or social media.
In his post, Tanal pointed out that Article 157 of the Criminal Procedure Code (CMK) stipulates that procedural actions during the investigation phase are confidential, and that Article 285 of the Turkish Penal Code (TCK) defines the violation of the confidentiality of an investigation as a crime. Reminding of the Constitution's provisions regarding the protection of private life and the inviolability of the home, Tanal stated, “The police are the power of the law; they are not a tool for political exposure.”
“Who filmed this footage? Who leaked it? Who provided it to the press? Who authorized this? The Public Prosecutor's Office must immediately uncover the source of this footage; it must initiate judicial and administrative investigations against those responsible.”
The source text did not contain information regarding whether there has been an official statement as to who filmed the footage and how it was leaked to the press. The common emphasis in the reactions was that the boundary between conducting judicial procedures and protecting the private lives of individuals must be observed.
