Subject: Minister of National Education; Criminal complaint from Doğru Party against the Chief Public Prosecutor of the Supreme Court

Minister of National Education Yusuf Tekin defended the collaborations made with religious sects and communities in his speech at the Grand National Assembly of Turkey (TBMM) on December 18, 2023. Tekin's remarks, in which he announced that they would continue to sign protocols with Non-Governmental Organizations (NGOs) affiliated with sects and communities, are drawing reactions. One such reaction to Tekin came from the Doğru Party. 

CENTER OF ANTI-SECULAR ACTIONS

Doğru Party Chairman Rıfat Serdaroğlu filed a criminal complaint with the Supreme Court of Appeals (Yargıtay). Emphasizing that Minister Tekin's statements were a confession that "We are governing the state together with sects and communities," Serdaroğlu included the following statements in the criminal complaint:

“The AKP is a party that was convicted by the Constitutional Court in 2008 for being the “Center of Anti-Secular Actions.”

The Minister of National Education's statement in the TBMM is the most important proof that the AKP is not just a center, but the very HUB of Anti-Secular Actions.

Furthermore, considering the places named after enemies of the Republic and Atatürk to this day, it is evidence that the AKP is knowingly and deliberately engaging in hostility toward the Republic and committing the crime of violating the Constitution;
The name of the Diyarbakır Dağkapı Square was changed to “Sheikh Said Square” 9 years ago.

The state's Governor named a boulevard in Diyarbakır “Sheikh Said” this year,

The Tunceli Municipality opened the Seyit Rıza park and erected his statue in the park.

The name of the traitor known as İskilipli Atıf was given to hospitals, schools, and streets by the AKP.

These are very important developments. It is impossible for them to have been done without the instruction of the AKP Chairman.
For a Governor to name a boulevard after Sheikh Said without his order is a sign of madness.

As a result, the AKP has learned no lessons from the 2008 Constitutional Court ruling or the July 15, 2016 FETÖ coup attempt; on the contrary, it has recklessly continued its anti-secular actions.”

Serdaroğlu made the following demands in the criminal complaint:

 “We are filing a CRIMINAL COMPLAINT against the Chief Public Prosecutor of the Supreme Court for failing to perform his duties and requesting an investigation in accordance with Article 46 of Law No. 5797.

As is known, the Office of the Chief Public Prosecutor of the Supreme Court is a unit affiliated with the Supreme Court.
Its duty is to ensure that high-level officials in Turkey are referred to the Supreme Council (Yüce Divan) when necessary and to file lawsuits with the Constitutional Court for the closure of harmful parties.

In recent years, we have been experiencing the most organized and largest attack on the Secular Republic in our Republican history. One would have to be blind not to see this reality.

By not filing a “closure case at the Constitutional Court” against the AKP, the Chief Public Prosecutor of the Supreme Court is adopting an attitude that could be understood as supporting reactionism. It will be a historic duty to have him tried and removed from office in order to protect our Constitution and the values of the Republic.”
