5-year prison sentence requested for individual who broadcasted 'Bir Yeraltı Sit-Com'u' starring Hasan Can Kaya without permission

The series "Bir Yeraltı Sit-Com'u", starring comedian Hasan Can Kaya, Günay Karacaoğlan, and Tuna Orhan, was released in 2021 on the Exxen platform, owned by Acun Ilıcalı.

The series was subsequently broadcast on a website that required a paid subscription, without any agreement in place.

Following the unauthorized broadcast of the series, a lawyer for the Exxen platform filed a complaint with the Anadolu Chief Public Prosecutor's Office, stating that the series "Bir Yeraltı Sitcom'u" had been broadcast on a website without permission and that its financial rights had been violated.

As a result of efforts to identify the suspect, it was determined that the suspect used a public bank as a payment instrument. Following an inquiry sent to the public bank, the suspect was identified as A.A.

The indictment also included an expert report. According to the expert report, the work in question was classified as a "cinematic work."

The report further stated that the rights holder of the "Bir Yeraltı Sit-Com'u" series is the Exxen platform and that it was understood to have been broadcast by the suspect via an IPTV channel using passwords provided in exchange for a fee.

In the indictment prepared by the Anadolu Chief Public Prosecutor's Office, it was stated that the work titled "Bir Yeraltı Sit-Com'u" was broadcast on the website owned and managed by the suspect A.A. without any contract, and it was requested that the suspect A.A. be sentenced to 1 to 5 years in prison or a judicial fine.
