Defne Samyeli and her daughter Derin Talu became victims of a fraud incident on the social media platform Telegram. On May 16, a message was sent to Derin Talu from a user named "Parcel Worldwide," requesting a payment of 255 dollars for a package allegedly sent from the famous fashion brand 'Miu Miu'.

Upon receiving this message, Derin Talu shared the situation with her mother, Defne Samyeli. Thinking the package might be real, the mother and daughter made the requested payment. However, after the package was not delivered, they realized they had been defrauded and filed a complaint with the Istanbul Chief Public Prosecutor's Office.

PROSECUTOR'S DECISION AND LEGAL PROCESS

Within the scope of the investigation initiated by the prosecutor's office, the suspect, identified as Meçhul S., was detained but released after giving a statement. The Istanbul Chief Public Prosecutor's Office issued a decision of non-prosecution, stating that the elements of the crime of fraud were not present in the incident. The prosecutor's office stated that for the crime of fraud to occur, the perpetrator must exhibit deceptive behavior that is severe and skillful enough to deceive the victim, and that these elements were not present in the current case.

The prosecutor's office also stated that the incident should be evaluated within the framework of private law, not criminal law. Therefore, it ruled that the parties should file a lawsuit in civil courts.
