WILL UZAY BE ABLE TO TAKE THE SABANCI SURNAME?
Whether Uzay, whose paternity as Hacı Sabancı's son has been confirmed, can take the Sabancı surname and his legal rights in this process are occupying the agenda.
The fact that Hacı Sabancı is confirmed to be the biological father of Uzay has also led to questions such as whether he will be able to receive a share of the Sabancı family's inheritance.
Attorney Bahar Ünlüer Öztürk answered the curious questions as follows:
The lineage of a child born to a married mother is automatically determined by the man the mother is married to. However, in such cases, with the court's decision following the DNA report (this is at the mother's initiative), the child can take the father's surname.
If Fatma Demir and Hacı Sabancı were married, the child would automatically take the father's surname without the need for a court decision.
However, if the mother is currently single, but is married to someone else within 300 days after becoming pregnant with the child, the child is still automatically registered under the name of the man the mother was married to during the 'waiting period' (iddet müddeti).
If the child's real father is someone else (it is known to be Hacı Sabancı), the child takes the father's surname with the court's decision as a result of the lawsuit filed.
In such a case, the child's lineage with the father is established by a court decision, but the lineage between the mother and the child occurs automatically with the birth of the child.
WHAT WILL UZAY'S RIGHTS BE AFTER TAKING THE SABANCI SURNAME? WILL HE BE ABLE TO RECEIVE HIS SHARE OF THE INHERITANCE?
If the mother wants him to use the Sabancı surname, Uzay will be able to use the Sabancı surname.
However, there is something more important than the surname. Along with the surname, Uzay's right to inheritance also arises. With the acquisition of the surname, Uzay will now be able to inherit from the Sabancı family.
DOES THE MOTHER FATMA DEMİR HAVE THE RIGHT TO ALIMONY?
Uzay's mother, Fatma Demir, will also be able to receive alimony. However, she needs to file a lawsuit for this as well. However, if the mother was pregnant with Uzay while married to someone else, due to the 'waiting period' (iddet müddeti) we mentioned, the child would be registered under the mother's ex-husband even if the mother is divorced. Therefore, in such a case, the mother must first annul the lineage between the ex-husband and the child. Then, she must have a paternity suit (with Hacı Sabancı) heard.
WHAT WILL HAPPEN TO NAZLI SABANCI? WILL SHE GET DIVORCED? WHAT ARE HER RIGHTS?
If she wants to divorce, Nazlı Sabancı has a justifiable reason. However, if this child (Uzay) was born from a relationship that occurred before her marriage to Nazlı Sabancı, Nazlı Sabancı cannot have a claim in such a situation.
However, if there is a situation that damages personal rights, Nazlı Sabancı has the right to file a lawsuit in such cases. The fact that such a situation is in the news does not earn Nazlı Sabancı compensation, but if there is defamation, the right to compensation naturally arises.
