He abused a 17-year-old girl with a mental disability: His testimony has emerged

In an incident that occurred in May in the Esenler district of Istanbul, Y.G.A. (17), a girl with a mental disability who had started working at a textile store, filed a complaint stating that she had been abused by her boss, Ali Kara.

In the indictment prepared as a result of the investigation into the incident, it was requested that Kara be sentenced to up to 35 years and 6 months in prison for the crimes of 'sexual abuse' and 'threat'. The trial of Kara under the prepared indictment has begun.

The detained defendant Ali Kara, the victim's mother S.D., and the lawyers for both parties were present at the hearing held at the Bakırköy 14th High Criminal Court.

"THIS HAPPENED WITH MUTUAL CONSENT"

In his defense at the hearing, defendant Ali Kara said, "I work in the men's clothing sector. I posted an ad due to a staff shortage at my workplace there. Ms. Y. came with her mother and stepfather. The victim Y. started working with me. When the victim arrived, she was extremely reserved, someone who would bow her head even while talking. We had to lay off a few employees during that process. Over time, I started talking to the victim. She asked me about my marriage. I told her about it too. After a certain point, the victim Y.'s attitude became sympathetic and interested. I didn't pay attention to it. One day she came with coffee in her hand. She approached me and hugged me. I was in a vulnerable moment. We got close. This happened with mutual consent and willingly. She threatened me by saying, 'either we get married or I will commit suicide, I will write a letter.' I do not accept the sexual intercourse allegations thrown at me. We only got close. My DNA was found on her underwear for this reason. This slander might have been made against me to extort money. But no money was demanded from me," he said.

"I THINK JUSTICE WILL BE SERVED, I AM FILING A COMPLAINT"

The victim's mother, the complainant S.D., stated, "I started my child at this creature's shop upon the advice of a psychologist doctor. The doctor said that working might be good for her. There were female employees there too. When I started my child at the job, I didn't say 'go ruin your life.' Because my daughter was afraid of me, she hid what happened from me for the first 2 days. My child then stood before me like a robot and said, 'Mom, what was done to me was done, Mom, I want to leave, I want to kill myself.' Then she told me what happened. The thing the person wants to do is to manipulate by mentioning money. I think justice will be served. I am filing a complaint," she stated.

The victim Y.G.A., who was not brought into the courtroom and gave her statement in the judicial interview room accompanied by a pedagogue, said, "Ali Kara was my boss. When I entered the workplace, everything was normal. One week after I started, he fired the employees one by one. A week later, he started coming to the shop. One day I went upstairs to pour tea. He came too. He tried to kiss me, I was in shock. I couldn't react. One day he told me, 'there is no camera upstairs, you will do what I say upstairs, but you won't be intimate downstairs, you will be serious.' He said, 'If you tell anyone about this, I have police acquaintances, I have prosecutor acquaintances.' One day I went upstairs to bring him tea. He said to me, 'can you look here, I will show you something.' He locked me in a room that had a bedroom and a bathroom. He told me, 'take off your clothes.' He undressed himself, he said, 'I will kill your mother and father.' Then he said, 'get on your knees.' There was nothing to do. I wanted it to end so I could leave. I sat down. He abused me. I felt disgusting," she said.

Following the victim's statement, the court announced its interim decision, ruling for the continuation of the defendant's detention and adjourned the hearing to address deficiencies.

FROM THE INDICTMENT

In the indictment prepared by the Bakırköy Chief Public Prosecutor's Office Domestic Violence Crimes Investigation Bureau, the incident that took place in Esenler on May 30 was described. In the indictment, it was stated that on the day of the incident, the victim Y.G.A. came to the Esenler Domestic Violence Bureau Command with her mother S.D. The victim's mother stated that her daughter Y.G.A., who has a mental disability, was subjected to sexual abuse by a person named Ali Kara, who was her boss. Within the scope of the investigation initiated regarding this statement, Y.G.A., whose statement was taken at the Child Monitoring Center, said that she started working at the store owned by Ali Kara 1 month ago and said, "One day while we were working, we started talking. I said to him, 'would you marry someone like me?' He replied, 'I would marry someone crispy like you.' A week later, he called me upstairs and tried to kiss me. I ran away. Then another day he kissed me."

It was also conveyed in the indictment that Ali Kara, who asked the victim to come upstairs by asking for tea on another day, forcibly removed the victim's clothes. It was also stated in the indictment that during his actions, Kara threatened the victim by saying that if she told anyone about these events, her family would be in trouble and her family would die, that he had long arms, and that he had judges and prosecutors he knew.

Defendant Ali Kara, in his statement regarding the incident, said, "The victim is my employee at the workplace. I hired her about 1 month ago upon the offer of her mother and father. During this process, I did not have any relationship other than an employee-employer relationship. In recent days, the victim felt emotional closeness towards me. Since I couldn't find another worker, I didn't fire the victim until I found a new worker. When she couldn't find a response to her feelings towards me, she slandered me.

I do not accept the accusations," he said. On the other hand, it was also stated in the indictment that the swab samples taken from the victim Y.G.A. and the blood samples taken from the suspect were sent to the Criminal Biological Examination Branch Directorate for examination. It was recorded in the report that arrived that DNA samples belonging to Ali Kara were found on the victim's underwear.

Then, changing his statement, Ali Kara also stated that the closeness happened with the victim's consent. It was requested that Kara be sentenced to up to 35 years and 6 months in prison for the crimes of 'sexual abuse' and 'threat'.
