Stabbed to death: 17-year-old defendant sentenced to 20 years in prison

The incident occurred on February 2, 2025, on Eski Demirciler Street in the Hisarbaşı Hocabedrettin neighborhood. Following a report of a person found motionless in a chair in the early hours of the morning, teams were dispatched to the scene. The Milas High Criminal Court, in the trial conductedin the capacity of ajuvenile court,heard the prosecution's closing arguments regarding the victimthat the victim was sleeping on the street at the time of the incidentand that the defendant approached with a knife in handand struck him in the shoulder, head, and chest area 7-8 times.The defendant fled after the incident,it wasstated that the knife usedwassurrendered to the police by the defendant's father and that the defendant was apprehended at her mother's house.

In the defendant's defense during the trial, she claimedthatshe was "harassed and threatened"that there was no evidence to support the claim, and according to the report from the Manisa Mental Health and Diseases Hospital,the defendantwas determined to have full criminal responsibility. The prosecution, based on thesegrounds, stated that the defendanthad committed the crime of "Intentional Killing of a Person Unable to Defend Themselves Physically or Mentally" andrequested that she be sentenced under Article 82/1-e of the Turkish Penal Code (TCK).

20-YEAR PRISON SENTENCE

In the final hearing, the court acquitted the defendant of the charge of "carrying a prohibited knife" under Law No. 6136, and for the crime of aggravated intentional murder of the victim, she was sentenced to aggravated life imprisonment.a life sentencewas given, and since the defendantwas 17 years old at the time of the crime,the sentence was reduced to 24 years under Article 31/3 of the Turkish Penal Code (TCK), and further reduced to 20 years by applying discretionary mitigation under TCK 62/1,reducing it, and considering the amount of the sentence,the defendant's detentionThe court decided againstthe deferment of the announcement of the verdict, suspension of the sentence, or the application of judicial controlprovisions, and ruledthat the defendant shall remain in custody.
