The issue of renting out homes for periods of less than 100 days has been regulated by law and regulation. Such rentals are considered “tourism-purpose rentals” and are subject to certain conditions.

WHAT MUST THE LESSOR DO?

1. The lessor must obtain a “tourism-purpose rental permit” from the Ministry of Culture and Tourism.

2. The Ministry may delegate this authority to the Governorates where the property to be rented is located.

3. A plaque with the specified characteristics of the rental must be hung at the entrance of the home used for tourism-purpose rental.

4. In the event that a property that is not a detached house is to be rented out, it is required that all flat owners provide their UNANIMOUS consent.

5. A copy of the rental permit must be submitted to the site (apartment) management.

WHAT HAPPENS IF THESE RULES ARE NOT FOLLOWED?

  1. If rented out without a permit, an administrative fine of 100,000 TL will be imposed for each home.

  2. A 15-day period will be granted to obtain a permit. If the permit is not obtained within this period and renting continues, a fine of 500,000 TL will be imposed. Another 15-day period will be granted.

  3. For those who continue without obtaining a permit despite this, 1,000,000 TL.

  4. For those who rent out the same home more than four times within one year from the date of the first contract, despite making rental contracts for periods longer than 100 days each time, 1,000,000 TL.

  5. If someone rents out a tourism-purpose home they leased from a permit holder to another person in their own name, they will also be fined 100,000 TL for each contract.

  6. Those who rent out a home they leased as a residence to someone else will also be fined 100,000 TL.

  7. For those who mediate the tourism-purpose rental of homes without a permit, 100,000 TL for each contract.

  8. For intermediary service providers that facilitate the electronic commerce and promotion of such activities and do not remove the content within 24 hours despite a warning from the Ministry, 100,000 TL for each home.

  9. If the plaque issued by the Ministry is not hung at the entrance of the homes used for tourism-purpose rental, 100,000 TL.

  10. A 15-day period is also granted for the plaque to be issued and hung. If it is not hung within this period, 500,000 TL.

Fines will be imposed. As can be seen, quite high administrative fines await those who do not act carefully within the framework of the provisions of this law and the regulation issued based on the law, which contain high-figure penal sanctions.
