A total of 221 former deputies and senators who served under the Republican People's Party (CHP) have issued a joint public statement against the "absolute nullity" (kesin hükümsüzlük) ruling regarding the 38th Ordinary Convention, where Özgür Özel was elected chairman.
Stating that the judiciary has become politicized and that the ruling is a heavy blow to democratic politics, the former deputies called for an extraordinary convention to be held within 45 days at the latest to resolve the "legal representation vacuum" created by the judiciary.
The declaration pointed out that election processes are conducted under the supervision of the Supreme Election Council (YSK) in accordance with Article 79 of the Constitution and that YSK decisions are final, emphasizing that the government is interfering in politics through the judiciary:
"If the YSK finds no irregularities and rejects the objection, it issues the certificate of election to the elected candidate. According to Article 79, the decision made by the YSK is final and cannot be appealed. The use of the government's judiciary as a tool to regulate politics is very dangerous for the democratic order and is opening wounds that are difficult to heal in the conscience of society."
"THE SOURCE OF LEGITIMACY IS THE WILL OF THE NATION"
Describing the cancellation of the 38th Convention, which was held 2.5 years ago, as an attack on the will of the nation, the 221 politicians continued their statement with the following words:
"The source of political legitimacy is the will of the nation. Ignoring the will that emerged at the ballot box shakes public trust in political institutions and justice. With the absolute nullity ruling, the constitutional order has been interfered with by a politicized judiciary. Those who support absolute nullity are those who do not stand on the right side of history and have no hope for the future."
45 DAYS FOR A SOLUTION: CONVENTION IMMEDIATELY
Emphasizing that the CHP cannot be directed by unconstitutional judicial decisions and stating that the solution lies in intra-party democracy and the will of the convention, the declaration included the following statements:
"The most correct, legitimate, and legal solution to resolve the divisions and debates that are being attempted to be created within the CHP, the founding party of the Democratic and Secular Republic, before they grow, is to IMMEDIATELY call for an Extraordinary Convention. The 'legal representation vacuum' currently created by the judiciary can be resolved in the fastest way possible through the will of an Extraordinary Convention to be held within 45 days at the latest."
The declaration also stated that Özgür Özel has made the CHP Turkey's leading party again and created great hope in the country, and that this hope must be sustained through the will of an extraordinary convention.
