Regarding the elected Hatay MP and TİP member Can Atalay,for whom the Constitutional Court (AYM) ruled a violation of rights, his lawyer Deniz Özen made statements regarding his release and the restoration of his rights.

CALL TO KURTULMUŞ

Speaking to Cumhuriyet newspaper, Özen stated that the process regarding Atalay sets a precedent, saying, "Without waiting for the 14th or 16th of the Parliament, the Parliament must register Atalay in the MP registry and restore his personal rights in accordance with the final decision of the Constitutional Court as soon as possible. It is a constitutional obligation for Numan Kurtulmuş to ensure this."

'HE MUST BE RELEASED IMMEDIATELY'

Özen stated, "The Constitutional Court declared that his detention has no 'legal basis' and that the situation constitutes 'unlawful confinement.' Since a member of parliament cannot be kept in prison, the Istanbul 13th High Criminal Court must issue an immediate release order."

Özen also emphasized that there is no need to wait for the end of the judicial recess for the court to make such a decision, noting that "the judicial recess procedure does not apply in cases of detention."
