CHP files application with the Constitutional Court regarding the 8th Judicial Package!
The CHP has filed an application with the Constitutional Court (AYM) for the annulment and stay of execution of provisions in the 8th Judicial Package concerning "aiding a terrorist organization without being a member," the "compensation commission," "deferment of the announcement of the verdict," and the "protection and processing of personal data."

CHP Group Deputy Chairman Gökhan Günaydın has filed an application with the Constitutional Court (AYM) seeking the annulment and stay of execution of the 'Law on Amendments to the Criminal Procedure Code and Certain Other Laws, No. 7499', publicly known as the 8th Judicial Package.
Speaking to reporters at the Constitutional Court building following the filing, Günaydın recalled that the 'Law on Amendments to the Criminal Procedure Code and Certain Other Laws' was published in the Official Gazette on March 12, 2024. In his statement, Günaydın noted that they had submitted a petition to the Constitutional Court requesting the annulment and stay of execution of certain provisions of the relevant law.
Stating that they would also share the regulations they are seeking to have annulled on the party's social media accounts, Günaydın reported that the articles in question concern 'aiding a terrorist organization without being a member,' the 'compensation commission,' 'deferment of the announcement of the verdict,' and the 'protection and processing of personal data.'
Günaydın made the following remarks in his statement:
“For example, this could lead to the detention and arrest of individuals and groups protesting for a constitutional right based on an arbitrary phrasing that begins with 'without being a member of a terrorist organization.' Therefore, we are requesting the annulment of this regulation. The Constitutional Court had previously annulled this regulation, but unfortunately, the People's Alliance majority in the Grand National Assembly of Turkey signed a new regulation that is not in compliance with the Constitutional Court's decision. Therefore, we are requesting its annulment. Furthermore, the compensation commission established before the European Court of Human Rights deprives citizens of their right to a fair and effective application. We believe it is correct for the process to be conducted through specialized commissions and specialized courts. Therefore, we are also requesting its annulment and a stay of execution. The regulation on the deferment of the announcement of the verdict is extremely arbitrary. It puts our lawyer colleagues, their clients, the defendants, and even the judges in a difficult position. Therefore, we are requesting its annulment to allow for a more accurate regulation to be made. In addition, there are highly objectionable provisions regarding the protection and processing of personal data. Health data, political party memberships, and association memberships can be processed without the person's consent and without any legal protection. There is absolutely no justifiable situation for this. We have come to the Constitutional Court regarding this stance, which completely violates citizen security."
