Closed files and pending IMM allegations at the HSK: What will Yılmaz Tunç do?

The response provided by Minister of Justice Yılmaz Tunç to a written parliamentary question submitted by the CHP revealed that one of the two applications made to the Council of Judges and Prosecutors (HSK) was not processed, while the other is still in the evaluation stage.

Minister of Justice Tunç, responding to the applications made to the HSK by CHP Chairman Özgür Özel, stated that one of the complaints was not processed, while the other is currently before him in his capacity as HSK President.

IMM 'CASE EXCHANGE' FILE PENDING

A complaint filed against Istanbul Chief Public Prosecutor Akın Gürlek and two prosecutors regarding allegations of "misconduct in office" and "violation of the confidentiality of an investigation" was not processed by the HSK. The other application, concerning allegations dubbed the "IMM Case Exchange" targeting the Istanbul Metropolitan Municipality, continues to wait before HSK President Yılmaz Tunç. A final decision on this file is expected.

ÖZEL’S PARLIAMENTARY QUESTION BROUGHT IT TO THE AGENDA

CHP Chairman Özgür Özel recently submitted a written parliamentary question to Minister of Justice Yılmaz Tunç, ensuring that these allegations were brought to the Parliament's agenda. Özel had requested that Tunç provide a response within 15 days.

In his response, Tunç stated that information regarding ongoing investigation procedures could not be provided, emphasizing the confidentiality and independence of the judicial process. Minister Tunç expressed that information regarding the investigation is not held by their Ministry and that no intervention can be made due to the independence of the judiciary.

Referring to the Code of Criminal Procedure regarding the investigation in question, Minister Tunç stated that prosecutors have the authority to conduct investigations. In this context, he emphasized that procedures such as the evaluation of evidence related to a crime and the filing of a public lawsuit belong to the judicial authorities.

THE FILE THAT WAS NOT PROCESSED HAS BEEN CLOSED

According to Tunç's statements, one of the two applications submitted by the CHP to the HSK was not processed by the HSK First Chamber on July 23, 2025, and the file was closed. This decision was approved by HSK President Yılmaz Tunç on July 29, 2025. As for the other file, a "non-processing" decision was also taken on September 11, 2025, but the procedures for this file have not yet been completed.
