This authority, previously granted by Decree-Law No. 703, had been annulled by the Constitutional Court in 2013. However, this authority is now being redefined within the scope of the law.
According to a report by Veli Toprak from Sözcü, with this authority, Erdoğan will be able to dismiss the lieutenants who took an oath saying "We are the soldiers of Mustafa Kemal" if they return to the TSK. The authority also covers the Land, Air, and Naval Forces, as well as the Gendarmerie and Coast Guard Commands.
The 35-article omnibus bill includes many legal provisions that were previously annulled by the Constitutional Court, and the regulations made by decree-law are now being presented as a law.
JUSTIFICATION OF INDISCIPLINE
The justification for the proposal states that the authority to be granted to Erdoğan is intended to ensure that quick and effective solutions can be taken against incidents of indiscipline that could undermine the effectiveness of the TSK.
