PKK and SDF detail in the execution regulation: 'If the crisis is not resolved...'

Following Minister of Justice Yılmaz Tunç's statement that there is no execution regulation in the 12th Judicial Package, it was alleged that he had contradicted MHP's Feti Yıldız. In his column today, Sözcü writer Saygı Öztürk stated that the words of Yıldız and Tunç do not contradict each other and that the execution regulation will be shaped according to the report to be prepared by the resolution process commission.

Drawing attention to the SDF crisis in Syria, Öztürk said: "The integration of the YPG, which is the Syrian branch of the PKK, into the Syrian army has not yet been achieved. They are not laying down their arms. In that respect, there is a major crisis. In other words, if they cannot resolve that crisis, there will be no execution regulation for PKK members either."

"In his latest statement, Feti Yıldız said that the current execution system needs to be changed entirely and that work is being done on this matter. On the same day, Yıldız's statement was asked to Minister of Justice Yılmaz Tunç. The Minister said, 'There is no regulation regarding the execution system in the 12th Judicial Package.'

The following picture emerged: Feti Yıldız said that a new execution system is being worked on. The Minister of Justice stated that there is no regulation regarding the execution system in the 12th Judicial Package. Feti Yıldız's statement was perceived as if it had been refuted by the Minister. But the situation is not like that at all. Feti Yıldız told the truth by stating that work is being done. Minister of Justice Yılmaz Tunç also told the truth by saying that there will be no regulation regarding the execution system in the 12th Judicial Package.

Let's look at what the contradictory statements mean and why both are telling the truth from their own perspectives:

The new execution reduction was enacted two weeks ago. So far, 38 thousand people have been released. This number is expected to reach 100 thousand within a year. The Minister states that apart from this, there is no such thing as an execution regulation in the 12th Judicial Package. Yes, there will be no execution regulation in the 12th Judicial Package. This package will reach the TBMM towards the end of January. Divorce cases and compensation cases will be separated from this package. Notary assistantship will be established. In other words, regulations in the legal and penal code will be made. Ultimately, there will be no execution regulation. 

The Minister was perceived as having refuted Feti Yıldız. But let's look at this aspect of the event: The regulation confirming Feti Bey is being worked on. The period of preparing a joint report within the scope of the work referred to as the 'resolution process' has begun. Execution regulations are also included in this work. The proposals to be prepared, together with the agreed-upon legal regulations, will be presented to the Speaker of the TBMM at the end of February.

A regulation regarding execution law will be handled at the end of February. In other words, the Minister says, 'There is no regulation regarding the execution system in the 12th Judicial Package,' and he is telling the truth. However, in the report that the commission will provide towards the end of February, the situation of more than 5 thousand PKK members in prisons and those abroad, and their execution system, will be handled in line with the commission's proposal.
