Call for a new constitution and enforcement law from Feti Yıldız

MHP Deputy Chairman and Constitutional Commission member Feti Yıldız has called for a new constitution and a new enforcement law in a statement made on his social media account.

Arguing that there is a broad consensus in society regarding a new constitution and enforcement regulation, Yıldız stated, "Just like a new constitution, there is a great consensus in society regarding a new enforcement law. Without a good enforcement regime, criminal justice cannot be fully achieved, no matter how good the Penal Code and Criminal Procedure Code may be."

"Everywhere in the world, the state's right to punish and the rights of the defendant are in conflict," said Yıldız, noting that respect for human rights and justice lie at the foundation of a state governed by the rule of law.

Calling on the Grand National Assembly of Turkey (TBMM), Yıldız also said that an enforcement law should be enacted that is simple, understandable, and centers on human dignity.

The full text of Yıldız's post is as follows:

"Just like a new constitution, there is a great consensus in society regarding a new enforcement law.

Without a good enforcement regime, criminal justice cannot be fully achieved, no matter how good the Penal Code and Criminal Procedure Code may be.

Everywhere in the world, the state's right to punish and the rights of the defendant are in conflict.

In a state governed by the rule of law, the boundaries of this conflict are drawn by laws, the constitution, and human rights conventions.

Every human being possesses fundamental rights and freedoms that are inherent to their personality, inviolable, inalienable, and indispensable.

Fundamental rights and freedoms are a natural consequence of being human.

They do not arise from an agreement, nor are they a favor.

State organs and administrative authorities must act in accordance with the principle of equality before the law in all their proceedings.

The purpose of the principle of equality described in our Constitution is to ensure that persons in the same legal situation are subject to the same treatment before the law.

A state that establishes protective justice respectful of human rights and is subject to judicial review is a state governed by the rule of law.

The TBMM must primarily

Enact an enforcement law that centers on human dignity,

Is uncomplicated and simple enough for convicts to understand alongside practitioners such as judges, prosecutors, and lawyers, considers the rehabilitative functions of punishment,

Ensures equality and justice in enforcement, does not lead to a perception of impunity,

And will not require frequent changes.

Furthermore,

A new constitution, along with legal reform, will shape Turkey's future.

Our attainment of a strong new constitutional framework that will protect Turkey's national identity, geographical integrity, and political unity in every aspect can no longer be postponed."
