Indictment prepared against former Maltepe Mayor Ali Kılıç

The investigation conducted against 32 suspects, including Maltepe Mayor Ali Kılıç, for the crime of "rigging a tender on behalf of a public institution or organization" has been completed. The indictment seeks a prison sentence of up to 12 years and 3 months for Mayor Kılıç for the crime of "repeatedly rigging a tender on behalf of a public institution or organization."

ACCUSED OF RIGGING VEHICLE RENTAL TENDERS

As part of the investigation carried out by the Anatolian Chief Public Prosecutor's Office's Bureau of Terror and Organized Crimes into allegations that 7 vehicle rental tenders at the Maltepe Municipality were rigged between 2019 and 2021, an indictment was prepared against 32 suspects, including Mayor Kılıç.

The indictment noted that in all 7 tenders, the approximate cost was determined in violation of the Council of Ministers' decision, and there was a discrepancy between the approximate cost, which should have been calculated in accordance with the legislation, and the contract price. The indictment stated that there were employer-employee, power of attorney, and commercial relationships among the firms invited by the municipality, that the tender processes were monitored by the same individuals, that the same IP addresses were used, that the same firm always won the tenders, and that the other invited firms either did not attend the tender or were eliminated by constantly submitting the same incomplete documents.

ALLEGATION OF CAUSING LOSS TO THE MUNICIPALITY

The indictment stated that some suspects created an approximate cost by obtaining bids from collusive firms in the tenders, and that the firms caused the municipality to suffer a loss by setting the approximate cost high, and that they concluded the tenders in their favor by conducting them in violation of fundamental principles.

The indictment explained that despite the Public Procurement Authority (KİK) decision, participation in the tender was restricted by preparing documents contrary to fundamental principles, ensuring that the same firm won the tenders, and that the municipality was caused to suffer a loss by setting the approximate cost above what it should have been through high bids received from the same firms in the tenders.

The indictment noted that there is sufficient evidence and suspicion to open a public lawsuit against Mayor Ali Kılıç and his deputy Salih Kara, regarding whom there is reasonable suspicion of prohibited acts and behaviors that occurred during the tender process, for committing the crime.

UP TO 12 YEARS AND 3 MONTHS IN PRISON SOUGHT

In the indictment, it was requested that 20 suspects, including Mayor Kılıç, be sentenced to 5 years and 3 months to 12 years and 3 months in prison for the crime of "repeatedly rigging a tender on behalf of a public institution or organization." For the other 12 suspects, a prison sentence of 3 to 7 years was requested for the crime of "rigging a tender on behalf of a public institution or organization." The indictment was sent to the Anatolian Criminal Court of First Instance.
