Muharrem İnce's fake footage trial adjourned: 9th Judicial Package detail

A decision was reached regarding the 12 defendants accused of circulating fake sexually explicit footage targeting Memleket Party Chairman Muharrem İnce.

Memleket Party Chairman Muharrem İnce and Chief Advisor to the President Maksut Serim were the subjects of a trial at the Ankara 35th Criminal Court of First Instance involving 12 defendants accused of circulating fake documents and posts created in their names.

 The defendants are being tried for "knowingly using forged private documents," "unlawfully obtaining or disseminating personal data," and "insult via audio, written, or video message," and it was stated that they face prison sentences ranging from 4 years to 9 years and 6 months. 

9TH JUDICIAL PACKAGE AWAITED

The public prosecutor stated that the 9th Judicial Package, which was accepted by the Grand National Assembly of Turkey (TBMM) on November 7 and introduces a pre-payment mechanism for insult crimes under Article 125/2 of the Turkish Penal Code (TCK), has not yet been published in the Official Gazette, and requested that the court evaluate whether this law should be applied. It was requested that if the package is not published, a decision be made according to the current opinion.

The lawyer for the complainant, Maksut Serim, stated that applying a law not yet published in the Official Gazette would "amount to external interference in the judiciary" and requested that the trial proceed under existing laws.

COURT DECIDES TO ADJOURN 

The judge announced that the case file would be reviewed and the necessary decision made after the 9th Judicial Package is published in the Official Gazette, and that if the law does not affect the case, the file will be taken under review for a verdict. It was decided that the next hearing will be held on January 29, 2025.
