Amendment to the Press Advertisement Agency Regulation

The amendment notification states that internet news sites are now required to use BİK Analytics and fulfill the necessary conditions for its operation. It has been decided that the traffic of sites that do not use BİK Analytics will be counted as zero.

It has been decided that BİK Analytics data will be audited at least once a year by institutions determined by the Public Oversight, Accounting and Auditing Standards Authority.

THE DIRECTORATE LISTS THE REGULATION AMENDMENTS

The amendments made by the General Directorate of the Press Advertisement Agency to the Official Advertisement and Notice Regulation are listed as follows:

ARTICLE 1- The following clause has been added to the first paragraph of Article 4 of the Official Advertisement and Notice Regulation published in the Official Gazette dated 1/2/2023 and numbered 32091.

“ğğ) BİK Analytics: The measurement tool, the ownership and naming rights of which belong to the Agency, which collects visitor traffic information of internet news sites,”

ARTICLE 2- In the first paragraph of Article 43 of the same Regulation, the phrase “1.50” has been changed to “4”, the phrase “2” has been changed to “6”, and the following sentence has been added to the second paragraph of the same article.

“Invoices issued for the sale of newspapers without commission are not taken into account in the actual sales calculation.”

ARTICLE 3- The sixth paragraph of Article 61 of the same Regulation has been amended as follows, and the following paragraphs have been added to the same article.

“(6) Internet news sites are obliged to use BİK Analytics and take the necessary measures to ensure its operation. The traffic data of internet news sites that do not take the necessary measures for the operation of BİK Analytics or do not cease activities that prevent its operation shall be accepted as zero, and proceedings shall be initiated in accordance with the provisions of the relevant legislation.”

“(7) The terms of use and technical details of BİK Analytics are determined by the General Directorate and announced on the Agency's websites.

(8) The compliance of the measurement processes performed by BİK Analytics regarding the visitor traffic of internet news sites with this article shall be audited at least once a year, upon the request of the Agency, in accordance with the relevant Turkish Auditing Standards, through an organization determined by the Board of Directors from among the independent audit firms authorized by the Public Oversight, Accounting and Auditing Standards Authority. After the audit, a report is prepared by the independent audit firm and submitted to the Agency.

(9) In case the measurement conditions specified in this article change, the Agency shall have a re-audit conducted.”

ARTICLE 4- This Regulation;

a) Article 2 shall enter into force on 1/1/2024,

b) Other provisions shall enter into force on the date of publication.

ARTICLE 5- The provisions of this Regulation shall be executed by the General Manager of the Press Advertisement Agency.
